The law in Vietnam stipulates that copyright means rights of an organization or individual to works which such organization or individual created or owns. Copyright includes moral rights and economic rights.

Pursuant to Articles 19 and 20 of the Law on Intellectual Property in 2005 stipulating moral rights and economic rights:

Moral rights [of authors] shall comprise the following rights:

- To give titles to their works.

Note: This right does not apply to translated works from this language to another language.

- To attach their real names or pseudonyms to their works; to have their real names or pseudonyms acknowledged when their works are published or used.

- To publish their works or to authorize other persons to publish their works: This is the act of publicly distributing a work in a reasonable number of copies to meet the demands of the public, depending on the nature of the work, carried out by the author or copyright owner, or by other individuals or organizations with the consent of the author or copyright owner. The publication of a work does not include the performance of a theatrical, film, or musical work; public reading of a literary work; broadcasting of literary or artistic works; exhibition of visual artworks; or construction of structures based on architectural works.

- To protect the integrity of their works; and to forbid other persons to modify, edit or distort their works in whatever form, causing harm to the honour and reputation of the author: This is the act of not allowing others to modify, abridge, or alter the work, or to modify or upgrade computer programs, except in cases where there is an agreement with the author.

Economic rights [of authors] shall comprise the following rights:

- To make derivative works;

- To display their works to the public: This right is exercised exclusively by the copyright owner or may be granted to others to directly perform the work or through recorded programs, audiovisual recordings, or any other technical means accessible to the public.

In this provision, the public performance of the work includes the performance of the work at any place other than the home.

- To reproduce their works: This right means that the copyright owner has the exclusive right to reproduce the work or permit others to reproduce the work in any form or by any means, including the regular or temporary storage of the work in electronic form.

- To distribute or import the original or copies of their works: This right is understood as the exclusive right of the copyright owner to carry out or authorize others to carry out, in any form or by any technical means accessible to the public, the sale, rental, or other forms of transfer of the original or copies of the work.

For visual artworks, including photographic works, the right of distribution also includes the display or exhibition in the public.

- To communicate their works to the public by wireless or landline means, electronic information networks or other technical means: This is the exclusive right of the copyright owner to perform or authorize others to perform, in a place and at a time of their choosing, the presentation of the work or a copy of the work to the public, in a manner accessible to the public.

- To lease the original or copies of cinematographic works and computer programs: This right is exercised exclusively by the copyright owner or may be granted to others to lease the work for a limited period of use.

Note: The right to lease does not apply to computer programs when the program itself is not primarily intended for rental, such as computer programs embedded in the normal operation of various types of transportation or other machinery and technical equipment.
