What are penalties for acts of infringing upon the right to rent copies of computer programs without permission of the copyright holders in Vietnam?

Pursuant to Article 14 of Decree 131/2013/ND-CP stipulating acts of infringing upon the right to rent originals or copies of cinematographic works or computer programs as follows:

A fine of between VND 5,000,000 and 10,000,000 shall be imposed for renting originals or copies of cinematographic works or computer programs without permission of the copyright holders in accordance with regulations.

According to this Article, those who lease copies of of computer programs without permission of the copyright holders in Vietnam shall be subject to a fine of between VND 5,000,000 and 10,000,000.

What are penalties for distributing the works without permission of the copyright holders in Vietnam?

According to the provisions in Article 15 of Decree 131/2013/ND-CP as amended by Clause 2, Article 3 of Decree 28/2017/ND-CP on acts of infringing upon the right to distribute works as follows:

1. A fine of between VND 10,000,000 and 30,000,000 shall be imposed for distributing the works without permission of the copyright holders.

2. Remedial measures:

Forcibly removing copies of the work which is infringed, in electronic form, on network and digital environment, or forcible destruction of material evidence of violation for act specified in Clause 1 of this Article.

According to this Article, distributing the works without permission of the copyright holders in Vietnam shall be subject to a fine of from VND 10,000,000 to VND 30,000,000 and be forced to remove copies of the work which is infringed or force the ddestruction of material evidence.
