Pursuant to Article 25 of Decree 131/2013/ND-CP, as amended and replaced by Clause 2, Article 3 of Decree 28/2017/ND-CP on acts infringing the rights to broadcast or otherwise transmit to the public a performance that has not been fixed as follows:

  1. A fine ranging from 20,000,000 VND to 40,000,000 VND for broadcasting or otherwise transmitting to the public a performance that has not been fixed without the permission of the performer’s right owner, except where the performance is intended for broadcasting.

  2. Remedial measures:

Compulsory removal of copies of the infringing performance in electronic form, on the internet, and in the digital environment, or destruction of the infringing material for the act specified in Clause 1 of this Article.

** In the aforementioned situation, livestreaming a musical performance without the permission of the organizer who owns the performer’s rights will be fined from 20,000,000 VND to 40,000,000 VND and must enforce the remedial measures as prescribed above. **

Unauthorized copying of the original video for distribution: Penalties

According to Article 26 of Decree 131/2013/ND-CP, as amended and replaced by Clause 2, Article 3 of Decree 28/2017/ND-CP on acts infringing the rights to distribute to the public the original or copies of a performance:

  1. A fine ranging from 10,000,000 VND to 30,000,000 VND for distributing to the public the original or copies of a performance without the permission of the performer’s right owner.

  2. Remedial measures:

Compulsory removal of copies of the performance in electronic form, on the internet, and in the digital environment, or destruction of the infringing material for the act specified in Clause 1 of this Article.

Thus, copying a video from the original recording of a musical performance to post online without the permission of the organizer who owns the performer’s rights will be fined from 10,000,000 VND to 30,000,000 VND and must enforce the remedial measures mentioned above.
