Is the case where a teacher photocopies a book of another author in multiple copies to sell to students a copyright infringement?

An English teacher at the center in Vietnam has photocopied practice books of another author (the book covers and answers have been removed). Then, he/she sold these photocopied books to students at the photocopy price. In this case, is there a copyright infringement?

Under Clause 6, Article 1 of the Law on Amendments to Intellectual Property Law 2009, the duplication of works for personal scientific research or teaching purposes is one of the cases of use of published works in which permission or payment of royalties or remunerations is not required in Vietnam.

Thus, this English teacher only may recital a copy (photocopy) of a book by another person for personal scientific research or teaching purposes. The case where the teacher photocopies the book in multiple copies to sell to students does not fall under the cases of use of published works in which permission or payment of royalties or remunerations is not required in Vietnam.

Therefore, in this case, the English teacher's actions constitute a copyright infringement.
