Failure to Pay Maintenance Fees Will Result in Termination of Protection Certificate Validity

I am the holder of the protection title of the invention; however, if I do not pay the fee to maintain the validity, will the protection title be terminated? It is past the deadline as stipulated.

According to Article 95 of the 2005 Intellectual Property Law, a protection title shall be terminated in the following cases:

- The protection title holder does not pay the fee for maintaining the validity or extending the validity as prescribed;

- The protection title holder declares to relinquish the industrial property rights;

- The protection title holder no longer exists, or the holder of the Trademark Registration Certificate ceases business activities without a lawful successor;

Thus, currently, you are the owner of a patent protection title, but if you do not pay the maintenance fee as prescribed, the protection title will be terminated.
