If I just finished 7th grade, do I have to perform military service in Vietnam? Will performing military service get extra points when taking university entrance exams in Vietnam? Will I receive vocational training support when demobilized from the police service in Vietnam?

Clause 1, Article 31 of the 2015 Military Service Law stipulates that a citizen shall be conscripted into the army if he/she satisfies the following conditions:

1. A citizen shall be conscripted into the army if he/she satisfies the following conditions:

a) Have conformable profile;

b) Strictly comply with the lines and policies of Communist Party, policies and laws of the State;

c) Have full health for service on active duty according to the regulations;

d) Have appropriate education level.

According to Clause 4, Article 4, Circular 148/2018/TT-BQP stipulates cultural standards as follows:

4. Cultural requirements:

a) Draft citizens who finished 8th grade or higher in descending order. In areas where the drafting quota cannot be guaranteed due to hardship, request the competent authorities to consider and decide to draft citizens who finished 7th grade.

b) Communes in remote and isolated areas, in areas with economic - social hardships according to regulations and law; ethnic minorities below 10,000 people shall draft no more than 25% of the citizens who finished primary education and the citizens who finished lower secondary education are drafted to fill the rest.

Thus, if you have just finished 7th grade and meet the standards of background, health, etc., you will still have to serve in the military if you are a citizen of the following localities in Vietnam:

- Localities with difficulties and unable to meet military delivery targets;

- Communes in remote areas and areas with particularly difficult socio-economic conditions;

- Ethnic minorities under 10,000 people.

According to Point a, Clause 1, Article 7 of the Regulation of admission to undergraduate programs and early childhood education college degree programs issued with Circular 09/2020/TT-BGDDT stipulates subgroup 03 of group 1 (UT1), specifically as follows:

1. Individuals given admission priority

a) Group 1:

- Subgroup 01: Vietnamese citizens being ethnic minority members with permanent address located (during high school or secondary school) in Zone 1, which is provided for in Point c Clause 4 herein;

- Subgroup 02: Production workers working for more than 5 consecutive years, 2 of which are awarded with the title of provincial model soldier or higher and certificates of merit thereof;

- Subgroup 03:

+ War invalids, sick soldiers and persons granted the certificate of entitlement to war invalid benefits;

+ Active duty conscripted members, commissioned officers, non-commissioned officers and servicemen of public security forces sent to study and serving for more than 12 months in Zone 1;

+ Active duty conscripted members, commissioned officers, non-commissioned officers and servicemen of public security forces sent to study and serving for more than 18 months;

+ Conscripted members, commissioned officers, non-commissioned officers and servicemen of public security forces having been discharged and recognized to have completed active duty conscription service per regulations;

+ Persons eligible for admission priority in compliance with regulations in Points i, k, l and m Clause 1 Article 2 of Ordinance No. 26/2005/PL-UBTVQH11 dated June 29, 2005 amending Ordinance No. 04/2012/UBTVQH13 dated July 16, 2012 by the Standing Committee of the National Assembly on preferential treatment for people with meritorious services to revolutions;

- Subgroup 04:

+ Children of revolutionary war martyrs;

+ Children of war invalids whose work capacity is reduced by at least 81%;

+ Children of sick soldiers whose work capacity is reduced by at least 81%;

+ Children of partisans exposed to toxic chemicals whose work capacity is reduced by at least 81%;

+ Children of persons whose work capacity is reduced by at least 81% and granted the certificate of entitlement to war invalid benefits;

+ Children of Heroes of the People's Armed Forces and children of Labor Heroes;

+ Biological children of partisans having physical disabilities due to toxic chemicals and currently receiving monthly benefits;

+ Children of people with meritorious services to revolutions mentioned in Points a, b and d Clause 1 Article 2 of Ordinance No. 26/2005/PL-UBTVQH11 dated June 29, 2005 amending Ordinance No. 04/2012/UBTVQH13 dated July 16, 2012 on preferential treatment for people with meritorious services to revolutions;

Thus, after you complete your military service in Vietnam, you will receive additional points when taking the university entrance exam.

In addition, Circular 148/2018/TT-BQP stipulates: Do not conscript citizens with health type 3 and eye disorders (1.5 dioptre myopia or higher, hypermetropia at all degrees); drug addicts, those contracted with HIV, AIDS.

So you can postpone military service for 1.5 diopters.

On the other hand, Clause 3, Article 41 of the 2015 Military Service Law stipulates: Citizens eligible for postponement of conscription prescribed in clause 1 of this Article shall be called up for military service if the reason for postponement is no longer available.

Therefore, you can join the military if you voluntarily join in Vietnam.

Will I receive vocational training support when demobilized from the police service in Vietnam? 

Will I receive vocational training support when demobilized from the police service in Vietnam? It's been 1 year since I joined the People's Public Security Service. I saw that my friend who returned from the service was supported in vocational training. So let me ask, when I am demobilized from the army, will I receive vocational training support?

According to Clause 2, Article 8, Decree 70/2019/ND-CP stipulates the regime of people who complete their police service as follows: During the period of active service and upon demobilization, non-commissioned officers and soldiers on duty are entitled to benefits and policies prescribed for non-commissioned officers and soldiers serving in the people's armed forces prescribed in Article 50 of the Law on Military Service 2015 and documents detailing implementation.

Refer to Article 50 of the 2015 Military Service Law, which stipulates policies for active duty non-commissioned officers/enlisted soldiers, demobilized non-commissioned officers/enlisted soldiers and their family as follows:

1. Regarding non-commissioned officers/enlisted soldiers during service in regular armed forces:

a) Provided promptly and sufficiently with conformable food, military equipment, medicine; provided with accommodation, monthly allowances, necessaries and cultural and spiritual needs according to characteristic and tasks of service; provided with incentives in holidays; provided with medical care according to the laws;

b) From the 13th month, active duty non-commissioned officers/enlisted soldiers may apply for leave under the regime; other irregular absence shall be regulated by the Minister of National Defense;

c) From the 25th month, active duty non-commissioned officers/enlisted soldiers may receive 250% of current monthly rank allowances;

d) Counted as a member of family when his/her family is allocated or adjusted an area of housing, residential land and/or farmland;

dd) Having the time duration on active duty included in working period of time;

e) Provided with preferential postage;

g) Provided with awards for good performance in combat, service or practice according to the law provisions;

h) Any active duty non-commissioned officers/enlisted soldiers who is injured or ill during the duty shall receive preferential regime according to the law provisions;

i) Covered by social insurance and medical insurance according to the Law on social insurance and the Law on medical insurance;

k) Any active duty non-commissioned officers/enlisted soldiers being members of disadvantaged households or students that receives loans from Vietnam Bank for Social Policies shall received a postponement of payment without interest according to the law provisions;

l) Provided with incentives in military enrollment.

Thus, when you join the police service and are demobilized from the army, you will receive job creation benefits in Vietnam.
