Will Circular 03/2023/TT-BTP amend and supplement some electronic forms of civil status documents in Vietnam?

On August 2, 2023, the Minister of Justice issued Circular 03/2023/TT-BTP amending and supplementing a number of contents of Circular 01/2022/TT-BTP detailing a number of articles of the Circular No. and measures to implement Decree 87/2020/ND-CP on electronic civil status database, online civil status registration.

According to Circular 03/2023/TT-BTP issued the following forms:

- Confirmation of civil status information; Declaration requesting certification of civil status information; Death notice (Appendix 1);

- Contents of integrated interactive electronic civil status forms, serving online civil status registration (Appendix 2);

- Sample of electronic copies of civil status papers (Appendix 3).

In addition, supplement and replace the Annexes issued together with Circular 01/2022/TT-BTP as follows:

- Supplementing Appendix 3 issued together with Circular 03/2023/TT-BTP.

- Replacing Appendix 1 and Appendix 2 with Appendix 1 and Appendix 2 issued together with Circular 03/2023/TT-BTP.

What is legal value of electronic forms of civil status documents in Vietnam?

In Clause 2, Article 9 of Circular 01/2022/TT-BTP, it is stipulated that electronic forms of civil status documents must comply with the provisions of Clause 6, Article 12 of Decree 87/2020/ND-CP and following instructions:

2. The legal value of electronic copies of civil status documents shall comply with the provisions of Clause 6, Article 12 of Decree No. 87/2020/ND-CP and the following instructions:

a) Electronic civil status documents have the same value as paper civil status documents in online transactions and administrative procedures; valid to replace paper civil status documents when carrying out civil status registration procedures directly at civil status registration offices.

b) The QRcode code on the electronic civil status document is the Internet address that leads to the data and image format of the corresponding civil status document in the electronic civil status database, which is valuable for providing information on the accuracy, validity and detailed information of civil status documents in the electronic civil status database.

c) Individuals, agencies and organizations when receiving electronic copies of civil status documents submitted and presented by civil status registration applicants may check the accuracy, expiry date and updated information of the electronic version of the civil status document through the QRCode on the electronic version of that document.

Thus, electronic copies of civil status documents have the same legal value as paper ones in transactions and administrative procedures carried out online; valid to replace paper civil status documents when carrying out civil status registration procedures directly at civil status registration offices in Vietnam.

- The QRcode on the electronic civil status document is the Internet address that leads to the data and image format of the corresponding civil status document in the electronic civil status database, which is valuable for providing information about the identity of the civil status document on the accuracy, validity and detailed information of civil status documents in the electronic civil status database.

- Individuals, agencies and organizations when receiving electronic copies of civil status documents submitted and presented by civil status registration applicants may check the accuracy, expiry date and updated information of the electronic version of the civil status document through the QRCode on the electronic version of that document.

What does information in electronic civil status database in Vietnam comprise?

In Clause 1, Article 3 of Decree 87/2020/ND-CP, information in electronic civil status database is as follows:

1. Information in electronic civil status database consists of:

a) Civil status information of an individual established during his/her birth registration includes: full name; date of birth; gender; place of birth, ethnic group, nationality, hometown, residence, personal identification number, personal identification document(s) of his/her parent(s); full name, personal identification number and personal identification document(s) of person(s) performing civil registration and relationship with the individual; registration number, book number, date of registration, name of birth registration agencies; full name and title of person signing birth certificate;

b) Civil status information of an individual who is a Vietnamese national whose birth registration has been adopted by a competent oversea agency established when he/she is registered in civil registers includes: full name; date of birth; gender; place of birth; ethnic group, nationality, hometown, personal identification number, personal identification document of the individual; full name, date of birth, ethnic group, nationality, hometown, personal identification number and personal identification document(s) of his/her parent(s); type of document, document number, date of issue, name of agency and country that issue civil status documents which serve as the basis for birth registration overseas; information on person performing birth registration; full name, personal identification number and personal identification document of applicant for birth registration; registration number, book number, date of registration, name of overseas agency performing birth registration; full name and title of person signing extract and specifying birth registration in civil registers;

c) Other civil status information of an individual updated in his/her civil status information which is established as specified under Point a and Point b of this Clause consists of: information on marriage registration; issuance of marital status verification; guardian(s); acknowledging parent(s) and child/children; adopting child/children; revision of civil status information, re-verification of ethnic group; declaration of death; recording revision of civil status according to judgments and decisions of competent authorities in civil registers; recording processed civil status affairs of a Vietnamese national by an oversea competent agency in civil registers;

d) Scanned or photo of page(s) of civil registers that contain information that is digitalized and standardized according to Point b Clause 2 of this Article.
