Who is Responsible for Reporting Temporary Residence When Visiting Relatives?
Pursuant to Article 31 of the 2006 Law on Residence, as amended and supplemented by Clause 5, Article 1 of the Law on Amendments to the Law on Residence in 2013:
- Temporary residence refers to the citizen's stay for a certain period at a location within a commune, ward, or commune-level town outside their place of residence and not in the case of a temporary residence registration requirement.
- The representative of the family, collective residence, medical facility, hotel, guesthouse, or other establishment that accommodates individuals has the responsibility to notify the residency to the Commune, Ward, or Commune-Level Town Police; in the case where individuals stay at a family home, collective residence, and the head of the family or manager of the collective residence does not have permanent residence registration in that commune, ward, or commune-level town, the person staying has the responsibility to notify the residence to the Commune, Ward, or Commune-Level Town Police. The notification of the stay can be done directly, by phone, or via the Internet or computer network. The Commune, Ward, or Commune-Level Town Police are responsible for informing the public of the location, Internet address, computer network address, and phone number for receiving stay notifications.
- Residence notifications must be made before 11:00 PM; if the stay occurs after 11:00 PM, the notification should be made the following morning. In the case of grandparents, parents, spouses, children, grandchildren, and siblings staying multiple times, only one residence notification is necessary.
