Which Authority is Competent to Correct Birth Certificates?
Clause 2, Article 26 of the Civil Status Law 2014 stipulates the scope of civil status changes, specifically:
Changes in information on parents in the registered birth certificate after being adopted according to the provisions of the Adoption Law.
Article 27 of this Law stipulates the authority to rectify civil status:
The People's Committee of the commune where the civil status was previously registered or where the individual resides has the authority to resolve the change and rectification of civil status for those under 14 years old; to supplement the civil status for Vietnamese citizens residing domestically.
Point b, Clause 2, Article 7 of this Law stipulates:
The People's Committee of the district registers the change and rectification of civil status for Vietnamese citizens aged 14 and above residing domestically; and re-determines ethnicity.
Thus, you have the right to rectify your child's birth certificate from the biological parents' names to your and your husband's names. In this case, if your child is under 14 years old, you can go to the People's Committee of the commune where the child's birth was previously registered or to the People's Committee of the commune where you reside to carry out this process. If your child is 14 years or older, you will conduct it at the People's Committee of the district.
