When registering a child's birth in Vietnam, do I need to submit a document on agreement on the selection of citizenship for my child?
I'm married to a foreigner, currently both are living in Hanoi, Vietnam. In the near future, if I want to register my child's birth, do I need to submit a document on agreement on the selection of citizenship for my child?
Pursuant to Clause 1, Article 36 of the Civil Status Law 2014 stipulates birth registration procedures for children as follows:
1. Birth registrants shall submit the papers specified in Clause 1, Article 16 of this Law to the civil status registration agency. In case either parent is or both parents are foreigner(s), a document on the agreement of the parents on the selection of citizenship for their child.
If the parents choose a foreign citizenship for their child, their agreement document must contain certification of a competent foreign state agency of which they are citizens.
Thus, according to the above-mentioned regulations, because the father of your child is a foreigner, at present both of you live in Hanoi, Vietnam so you must submit a document on the agreement of the parents on the selection of citizenship for your child in accordance with the above provisions.
Best Regards!
