What shall be done when there is information that negatively affects honor and dignity on social media? What are the fines for acts of insulting, dishonoring, and insulting dignity on social media?

What to do if there is information that affects honor and dignity on social media in Vietnam?

Pursuant to Article 34 of the Civil Code in 2015 stipulating right to protection of honor, dignity and prestige as follows:

1. Honor, dignity and prestige of an individual is inviolable and protected by law.

2. Each individual has the right to request a court to reject any piece of information adversely affecting to his/her honor, dignity and/or prestige.

The honor, dignity and prestige of a deceased person shall be protected at the request of his/her spouse or grown children; or his/her parent if he/she has no spouse or child, unless otherwise prescribed by law.

3. If a piece of information adversely affecting to the honor, dignity and prestige of a person is posted on a mean of mass media, that piece of information shall be removed or rectified by that kind of mean. If that piece of information is kept by an agency, organization or individual, such entity is required to cancel it.

4. In case it is impossible to identify the person informing the information adversely affecting the honor, dignity and/or prestige of a person, the latter person has the right to request a court to declare that such piece of information is incorrect.

5. The person receiving the information adversely affected his/her honor, dignity and/or prestige both has the right to request rejection of such piece of information and has the right to require to informing person gives a public apology and rectification and compensation.

Therefore, when there is information that negatively affects honor, dignity, and reputation on social media, the affected individual has the right to request the poster to remove and correct it using the same mass media that posted it. If the poster cannot be identified, the individual has the right to request the Court to declare that the information is incorrect.

What are the fines for acts of insulting, dishonoring, and insulting dignity on social media in Vietnam?

Pursuant to Article 101 of the Decree 15/2020/NĐ-CP (amended by Clause 37 Article 1 of the Decree 14/2022/NĐ-CP) stipulating violations of regulations on the responsibility for using social media services; websites established through social media as follows:

1. A fine ranging from VND 10,000,000 to VND 20,000,000 shall be imposed for the commission of one of the following violations:

a) Providing/sharing fake or false information with the aims of distorting, slandering or damaging the prestige, honor and dignity of other organizations, authorities or individuals;

b) Providing/sharing information with the aims of encouraging unsound customs, superstitions or pornography, or which is not conformable with the national good traditions and customs;

c) Providing/sharing information describing in detail acts of cutting off/killing, accidents, horror and frightful acts;

d) Providing/sharing fictitious information with the aims of causing a panic among the population, inciting violence, crimes, social evils, gambling or serving gambling activities;

dd) Providing/sharing journalistic, literature and arts works and other publications without the consent from holders of intellectual property rights over such works, or which are not allowed to be distributed or subject to a distribution prohibition or confiscation decision;

e) Advertising, disseminating or sharing information on prohibited goods/services;

g) Providing/sharing images of Vietnam’s map which does not indicate the entire and accurate national sovereignty;

h) Providing/sharing paths/links to prohibited information on networks.

2. A fine ranging from VND 20,000,000 to VND 30,000,000 shall be imposed for disclosing information classified as state secret, an individual’s privacy or other secrets if not liable to criminal prosecution.

3. Remedial measures:

Enforced removal of false, misleading or violating information in case of commission of any of the violations in Clause 1 and Clause 2 of this Article.

As regulations above, a person who commits an act of insulting the honor and dignity of others on social media will be fined from 10 million to 20 million VND.
