Are citizens in Vietnam allowed to decide their place of residence?
Pursuant to Article 8 of the Law on Residence 2020 stipulating the rights of citizens regarding residence:
Article 8. Rights of Citizens Regarding Residence
- Choose and decide their place of residence, register residence in accordance with the provisions of this Law and other relevant laws.
- Have their personal information, family information in the Residence Database kept confidential, except when provided as prescribed by law.
- Access their residence information in the National Database on Population; be confirmed regarding residence information by the registration agency nationwide, regardless of their residence place, upon request.
- Have their residence information updated and adjusted in the Residence Database upon changes or requests.
- Be provided with information and documents related to the exercise of their freedom of residence, upon request.
- Be protected by competent state agencies regarding the enforcement of the right to freedom of residence.
- Lodge complaints, denunciations, and lawsuits regarding violations of the law on residence as prescribed by law.
According to the above regulations, citizens have the right to choose and decide their place of residence and register residence in accordance with the provisions.
In what cases can information regarding a citizen's residence in Vietnam be adjusted?
Pursuant to Article 26 of the Law on Residence 2020 stipulating the adjustment of residence information in the Residence Database:
Article 26. Adjustment of Residence Information in the Residence Database
- The adjustment of citizen's residence information is carried out in the following cases:
a) Change of household head;
b) Change of civil status information compared to information stored in the Residence Database;
c) Change of address in the Residence Database due to adjustments in administrative unit boundaries, administrative unit names, street names, hamlets, villages, lot numbers.
- The dossier for adjustment of residence information stipulated at Points a and b, Clause 1 of this Article includes:
a) Declaration form for changing residence information;
b) Documents and proof of adjustment.
- The procedure for adjusting residence information is carried out as follows:
a) For the case stipulated in Point a, Clause 1, the household member submits the dossier specified in Clause 2 to the residence registration agency. Within 3 working days from the date of receiving a complete and valid dossier, the residence registration agency is responsible for adjusting the information on the household head in the Residence Database and notifying the household member of the update; in case of refusal to adjust, a written notice specifying the reason must be issued;
b) For the case stipulated in Point b, Clause 1, within 30 days from the date of the decision by the competent authority to change civil status information, the individual whose information is to be adjusted submits the dossier for adjustment registration in the Residence Database as specified in Clause 2 to the residence registration agency.

Thus, the adjustment of a citizen's residence information is carried out in the following cases:
- Change of household head;
- Change of civil status information compared to information stored in the Residence Database;
- Change of address in the Residence Database due to adjustments in administrative unit boundaries, administrative unit names, street names, hamlets, villages, numbering methods.
