What is the penalty for giving a bribe for residence registration?
I have just moved back to live with my grandparents. Therefore, when I registered for permanent residence, I intended to give some money to the officer so that they could help me speed up the procedures. Is it illegal to do that? If I get caught, will I be fined?
Is it legal to use money to speed up the permanent residency procedures in Vietnam?
Article 7 of the Law on Residence 2020 stipulates prohibited acts as follows:
- Obstruct a citizen from exercising their right to freedom of residence.
- Misuse information on permanent or temporary residence to restrict a citizen’s legitimate rights and interests.
- Give, broker or receive a bribe for residence registration or management.
- Fail to receive or postpone receipt of residence registration documents or information or other acts of harassment; fail to process or process a valid application for residence registration in a belated manner; annul permanent or temporary residence registration against regulations of law.
- Collect, manage or use residence registration charges against regulations of law.
Thus, according to the above regulations, bribery in the registration of residence is strictly prohibited, so you must not commit this act.
What is the penalty for giving a bribe for residence registration in Vietnam?
Pursuant to Clause 3, Article 9 of Decree 144/2021/ND-CP, A fine ranging from 2.000.000 VND to 4.000.000 VND shall be imposed for any of the following violations:
- Allowing another person to join the residence for personal gain;
- Operating a lodging establishment, tenement, treatment facility, tourist accommodation or any other lodging facility without notifying the accommodation of 04 - 08 guests;
- Obstructing a citizen from exercising his/her freedom of residence.
- Giving, brokering, receiving bribes in residence registration and management.
Thus, if you commit the act of giving bribes when registering for permanent residence, you may be fined from VND 2,000,000 to VND 4,000,000.
