According to Article 24 of the Law on Civil Status 2014, the authority responsible for registration of parent and child recognition is as follows:

The People's Committee at the commune level where the recipient or the person being received as a parent or child resides is responsible for registration of parent and child recognition.

According to Article 43 of the Law on Citizenship 2014, the authority responsible for registration of parent and child recognition is as follows:

The People's Committee at the district level where the accepted parent or child resides is responsible for registering the receipt of a parent-child relationship between a Vietnamese citizen and a foreigner; between a Vietnamese citizen residing in the country and a Vietnamese citizen settled abroad; between Vietnamese citizens settled abroad; between Vietnamese citizens holding dual nationality and Vietnamese citizens or foreigners; between foreigners residing in Vietnam.

Case 1: Procedure for registration of parent and child recognition in Vietnam at the commune-level People's Committee

According to Article 25 of the Law on Civil Status 2014, the procedure for registration of parent and child recognition in Vietnam at the commune-level People's Committee is as follows:

Step 1: The requesting party submits a declaration in the prescribed form and supporting documents proving the parent-child relationship to the registration authority. All parties involved must be present during the registration process.

Step 2: Within a period of 3 working days from the date of receiving all required documents as stated in paragraph 1 of this Article, if the registration of the parent-child relationship is deemed correct and uncontested, the judicial officer in charge of citizenship records it in the Household Registration Book. Both the requesting party and the registration authority sign the Household Registration Book, and the registration authority reports to the Chairman of the commune-level People's Committee to issue an excerpt for the requesting party.

In cases where verification is necessary, the timeframe may be extended for no more than 5 working days.

Case 2: Procedure for registration of parent and child recognition in Vietnam at the district-level People's Committee

According to Article 44 of the Law on Civil Status 2014, the procedure for registration of parent and child recognition in Vietnam at the district-level People's Committee is as follows:

Step 1: The requesting party submits a declaration and the necessary documents, materials, or other evidence to prove the parent-child relationship to the registration authority, including:

+ Documents from competent health, inspection, or other authorities, both domestic and foreign, certifying the parent-child relationship.

+ In the absence of the above-mentioned evidence, a written declaration from the receiving parties, with at least two witnesses testifying to the parent-child relationship, is required.

In cases where the parent-child relationship involves a Vietnamese citizen and a foreigner or between foreigners, the foreign party must also submit a copy of their passport or other valid substitute documents to prove their identity.

Step 2: Within a period of 15 days from the date of receiving all required documents, the citizenship officer verifies and posts the registration of parent and child recognition at the headquarters of the district-level People's Committee for a continuous period of 7 days.

At the same time, a written request is sent to the commune-level People's Committee at the place of permanent residence of the accepted parent or child to post the registration for a continuous period of 7 days at the headquarters of the commune-level People's Committee.

Step 3: The Department of Justice reports and proposes to the Chairman of the district-level People's Committee to make a decision on the registration of parent and child recognition if all conditions are met.

Step 4: All parties involved must be present during the registration process. The citizenship officer records the registration in the Household Registration Book, and all parties sign the Household Registration Book.

The Chairman of the district-level People's Committee issues an excerpt to all parties involved.
