Based on Article 27 of the Law on Residence 2020 on the conditions for temporary residence registration:
Article 27. Conditions for Temporary Residence Registration
- Citizens who come to live at a legal residence outside the administrative unit boundary of the commune where they have permanent residence registration to work, study, or for other purposes for 30 days or more must register for temporary residence.
- The maximum duration for temporary residence is 02 years and can be renewed multiple times.
- Citizens are not allowed to register new temporary residence at the places stipulated in Article 23 of this Law.
Thus, citizens are allowed to register for temporary residence when the following conditions are met:
- Citizens who come to live at a legal residence outside the administrative unit boundary of the commune where they have permanent residence registration to work, study, or for other purposes for 30 days or more must register for temporary residence.
- The maximum duration for temporary residence is 02 years and can be renewed multiple times.
- Not registering new temporary residence at the following places:
+ Residences located in banned locations, prohibited construction zones, or encroaching on the security, defense, traffic, irrigation, dike corridor, energy, technical infrastructure protection landmarks, ranked historical-cultural monuments, areas warned of landslide, flash flood, torrent flood risks, and areas protecting other works as per legal regulations.
+ Residences where the entire housing area is on illegally encroached land or constructed on land not meeting construction conditions as per legal regulations.
+ Residences already earmarked for land recovery and have approved plans for compensation, support, and resettlement by competent state agencies; residences with disputes, complaints regarding ownership, or use rights yet unresolved as per legal regulations.
+ Residences seized under decisions by competent state authorities; means used as places for permanent residence registration that have had their vehicle registration canceled or lack certifications for technical safety and environmental protection as per legal regulations.
+ Residences that are subject to demolition decisions by competent state agencies.

a) A declaration form for changing residence information; for minors registering for temporary residence, the declaration form must clearly state the consent of their parents or guardians, except when written consent is available.
b) Documents and materials proving legal residence.
- The individual registering for temporary residence submits the registration dossier to the residence registration agency where they plan to reside temporarily.
Upon receiving the temporary residence registration dossier, the residence registration agency will check and issue a receipt to the applicant; if the dossier is incomplete, they will guide the applicant to supplement it.

Which documents of legal accommodation are used for temporary residence registration in Vietnam?
According to Clause 3, Article 5 of Decree 154/2024/ND-CP, documents and materials proving legal residence for temporary registration include one or more of the following:
[1] One of the following documents:
- Documents or materials certifying land use rights, ownership of assets attached to land issued by competent authorities at different times according to land and housing laws
- Housing construction permits or temporary housing construction permits for cases requiring building permits as per construction law
- Documents of purchase and sale of state-owned housing or documents of valuation, liquidation of housing attached to state-owned homestead land according to the law
- Contracts of housing purchase and sale or documents proving the handover or receipt of housing from real estate enterprises for sale
- Documents of purchase, lease-purchase, gifting, inheritance, capital contribution, exchange of housing in accordance with the land and housing laws
- Documents for gifting gratitude houses, charity houses, solidarity houses, providing housing, homestead land to individuals or households
- Documents from the Court or competent authorities resolving ownership of housing enforceable by law
- Documents and materials proving mortgage, pledge of ownership rights to legal residence
- Confirmation from the communal People's Committee regarding stable, undisputed housing, and not in locations not permitted for new permanent residence registration
- Documents and materials proving ownership registration, inspection of vehicles, certification of regular parking places, except for cases where registration is not required
- Contracts or documents for renting, borrowing, or staying as a guest, notarized or authenticated as per the law
- Any other types of documents or materials for consideration of issuing land use rights certificates, property ownership linked to land according to land and housing laws at varying times
[2] Written commitment by the citizen confirming residence under their use, free of usage rights disputes, and ongoing stable, permanent residence at the site if no documents or materials stipulated in [1] are available.
The declaration contains: Full name; date of birth; personal identification number; place of residence; information on the residence proposed for temporary registration and the citizen's commitment.
[3] Documents and materials from the owner of the tourist accommodation or other facilities allowing individuals to register for temporary residence there.
[4] Documents from the management agency of industrial zones, export processing zones, economic zones allowing workers to register for temporary residence at their legally owned or managed accommodations.
[5] Documents from the management agency of construction sites, dormitories, villages, production bases, and organizations allowing workers to register for temporary residence at accommodations under their legal ownership or management.
