What is the deadline for submitting or sending a report on the loss of laissez-passers inside Vietnam?
According to Article 11 of Decree 76/2020/ND-CP, which was amended by Clause 5 of Article 1 of Decree 67/2024/ND-CP, there are provisions regarding the cancellation of the validity of lost laissez-passers as follows:
Cancellation of the validity of lost laissez-passers:
1. In the case of lost domestic laissez-passers, within a period of 02 working days from the date of discovering the loss, the person who lost the laissez-passer must directly submit or send a report on the loss of the laissez-passer using the M02a form issued with this Decree to the Immigration Management Agency of the provincial or district-level police where it is convenient or on the electronic platform at the National Public Service Portal or the Public Service Portal of the Ministry of Public Security. In case of force majeure, the deadline for submitting or sending the report on the loss of the laissez-passer may be extended, but the specific reasons for the force majeure must be explained in the report.
Within a period of 01 working day from the date of receiving the report on the loss of the laissez-passer, the receiving agency is responsible for notifying the issuing authority of the laissez-passer to cancel its validity as prescribed in Clause 4 of this Article.
2. In the case of lost laissez-passers abroad, within a period of 02 working days from the date of discovering the loss, the person who lost the laissez-passer must report to the competent authority of the host country to carry out procedures to confirm the loss of the laissez-passer and facilitate departure; upon returning to Vietnam, they must report the loss of the laissez-passer to the immigration control unit of Vietnam at the border checkpoint.
3. The immigration control unit at the border checkpoint is responsible for receiving the report from the person who lost the laissez-passer abroad and issuing an entry certificate using the M03 form issued with this Decree to the person who lost the laissez-passer.
4. Within a period of 01 working day from the date of receiving the report on the loss of the laissez-passer or the notification of the transfer of the report on the loss of the laissez-passer or the entry certificate from the immigration control unit at the border checkpoint, the issuing authority of the laissez-passer shall cancel the validity of the lost laissez-passer and notify the provincial border guard command where the citizen was issued the laissez-passer.
Therefore, the deadline for submitting or sending a report on the loss of domestic laissez-passers is 02 working days from the date of discovering the loss.
However, if there are unforeseen circumstances, the deadline for submitting or sending the report on the loss of the laissez-passer may be extended, but the specific reasons for the unforeseen circumstances must be explained in the report.
Who is eligible to be issued a laissez-passer in vietnam?
According to Article 4 of Decree 76/2020/ND-CP (amended by Clause 6 Article 1 of Decree 67/2024/ND-CP), the eligible individuals to be issued a laissez-passer are as follows:
- Individuals eligible for a Vietnam-Cambodia border laissez-passer include officials, civil servants, employees working in agencies, organizations, and enterprises based in a province that shares a border with Cambodia and are assigned to work in the neighboring border province of Cambodia.
- Individuals eligible for a Vietnam-Laos border laissez-passer include:
+ Vietnamese citizens residing in a province that shares a border with Laos.
+ Vietnamese citizens who are not residents of provinces sharing a border with Laos but work in agencies, organizations, and enterprises based in a province that shares a border with Laos.
- Individuals eligible for a Vietnam-China border entry-exit laissez-passer include:
+ Vietnamese citizens residing in communes, wards, towns adjacent to the Vietnam-China border.
+ Officials, civil servants working in state agencies with headquarters located in districts, towns, cities within the border province of Vietnam adjacent to the Vietnam-China border and are assigned to work in the neighboring border area of China.
