What Compensation Costs Are Required for Violating a Corpse?
According to Article 606 of the 2015 Civil Code, which provides regulations on compensation for damage caused by the violation of a body. To be specific:
Individuals or legal entities that violate a body must compensate for the damage.
Damages caused by the violation of a body include reasonable expenses to mitigate and remedy the damage.
The person responsible for compensating when the body is violated must compensate according to Clause 2 of this Article and an additional amount to compensate for the mental loss of the next of kin in the first order of succession of the deceased. If there are no such persons, the person directly nurturing the deceased shall be entitled to this amount. The compensation amount for mental loss shall be agreed upon by the parties; if no agreement is reached, the maximum amount for each violated body shall not exceed thirty times the statutory pay rate specified by the State.
According to this regulation, it can be determined that there are 02 types of costs (amounts) that individuals or legal entities violating a body must compensate for:
- Reasonable expenses to mitigate and remedy the damage caused by the violating act.
- An amount to compensate for the mental loss of the next of kin in the first order of succession of the deceased (if there are no such persons, the person directly nurturing the deceased).
