What are the regulations for reclaiming secured property?

Based on Article 57 of Decree No. 21/2021/ND-CP (effective from May 15, 2021), the content is stipulated as follows:

1. The secured party is entitled to recover the collateral in the following cases:

a) Completion of the obligations stipulated in Article 302 of the Civil Code;

b) The collateral has been replaced or exchanged with other assets;

c) The secured obligation has been settled by offsetting obligations;

d) Other cases as agreed upon or as prescribed by the Civil Code and other relevant laws where the collateral is not to be disposed of.

2. In the case specified in Clause 1 of this Article, if the law on asset auction or other relevant laws stipulate obligations to be performed before recovering the collateral, the secured party may only recover the collateral after such obligations have been fulfilled.
