What is an electronic identification account according to the law in Vietnam?

Based on Clause 5 of Article 3 of Decree 69/2024/ND-CP, an electronic identification account is a collection consisting of a username, password, or other authentication means established by the identity and electronic authentication management agency. It is used to access and use the features, utilities, applications of the electronic identification and authentication system, and the connected and shared information system as regulated by law.

What are the procedures for locking and unlocking electronic identification accounts (VNeID) implemented from July 1, 2024 in Vietnam?

Based on Clause 15 of Decree 69/2024/ND-CP, the procedures for locking and unlocking electronic identification accounts (VNeID) from July 1, 2024 are as follows:

(1) Locking and unlocking electronic identification accounts of Vietnamese citizens

The automatic electronic identification and authentication system will lock and unlock the electronic identification accounts of citizens when their electronic identity cards are locked or unlocked, or when their citizen identity cards or expired citizen identity cards are used.

(2) Locking electronic identification accounts of foreigners and organizations

- The automatic electronic identification and authentication system will record, check, authenticate, and lock electronic identification accounts in the following cases: foreigners requesting the locking of their electronic identification accounts; foreigners violating the agreement on using the National Identification Application; expiration of passports or international travel documents of foreigners; expiration of the residency period of foreigners in Vietnam; death of foreigners.

The recording is done through the declaration by foreigners on the National Identification Application or the update of information as specified in Clause 8 of Decree 69/2024/ND-CP;

- The automatic electronic identification and authentication system will record, check, authenticate, and lock electronic identification accounts in the following cases: organizations requesting the locking of their electronic identification accounts; organizations violating the agreement on using the National Identification Application; dissolution, bankruptcy, suspension, or termination of activities of the organization according to the law.

The recording is done through the declaration by the organization on the National Identification Application or the update of information as specified in Clause 8 of Decree 69/2024/ND-CP;

- The judicial authorities, other competent authorities shall send a request form for locking or unlocking electronic identification accounts and electronic identity cards to the commune police, ward, town or the identity card management agency of the provincial police or district police nearest to them for receipt and processing;

- Within 1 working day from the date of receiving the request form for locking or unlocking electronic identification accounts and electronic identity cards from the judicial authorities, other competent authorities, the commune police, ward, town or the identity card management agency of the provincial police or district police receiving the request must review and transfer the request for locking electronic identification accounts to the head of the identity card management agency of the Ministry of Public Security for consideration and approval through the electronic identification and authentication system;

- Within 2 working days from the date of receiving the proposal from the commune police, ward, town or the identity card management agency of the provincial police or district police, the head of the identity card management agency of the Ministry of Public Security must consider and approve the request for locking electronic identification accounts as prescribed in Clause (2) and notify the agency requesting the locking of the electronic identification accounts and the subject whose accounts are locked.

In case of refusal to lock electronic identification accounts, a written response must be provided stating the reasons.

(3) Unlocking electronic identification accounts

- The automatic electronic identification and authentication system will automatically unlock electronic identification accounts when there is no basis for locking the accounts;

- The judicial authorities, other competent authorities shall send a request form for locking or unlocking electronic identification accounts and electronic identity cards to the commune police, ward, town or the identity card management agency of the provincial police or district police nearest to them for receipt and processing;

- Within 1 working day from the date of receiving the request form for locking or unlocking electronic identification accounts and electronic identity cards from the judicial authorities, other competent authorities, the commune police, ward, town or the identity card management agency of the provincial police or district police receiving the request must review and transfer the request for unlocking electronic identification accounts to the head of the identity card management agency of the Ministry of Public Security for consideration and approval through the electronic identification and authentication system;

- Within 2 working days from the date of receiving the proposal from the commune police, ward, town or the identity card management agency of the provincial police or district police, the head of the identity card management agency of the Ministry of Public Security must consider and approve the request for unlocking electronic identification accounts as prescribed in Clause (2) and notify the agency requesting the unlocking of the electronic identification accounts and the subject whose accounts are unlocked.

In case of refusal to unlock electronic identification accounts, a written response must be provided stating the reasons.
