What are the penalties on child marriage in Vietnam? Who has the right to request annulment of child marriage in Vietnam?
Hello Lawnet. I am a Tay ethnic and I am 15 years old this year. My father forces me to marry an 18-year-old man, who lives in the same village with me. I don't want to follow it because I don't like my life being tied up in an undeveloped environment like this. Is this act considered child marriage? What are the penalties on child marriage?

What are the penalties on child marriage in Vietnam?
Pursuant to Clause 8, Article 3 of the Law on Marriage and Family in 2014 stipulating child marriage in Vietnam as follows:
8. Child marriage means getting married when one or both partners has or have not reached the marriage age prescribed at Point a, Clause 1, Article 8 of this Law.
Pursuant to Clause 1, Article 8 of the Law on Marriage and Family in 2014 stipulating conditions for getting married in Vietnam as follows:
a /The man is full 20 years or older, the woman is full 18 years or older;
b/ The marriage is voluntarily decided by the man and woman;
c/ The man and woman do not lose the civil act capacity;
d/ The marriage does not fall into one of the cases prescribed at Points a, b, c and d, Clause 2, Article 5 of this Law.
Pursuant to Article 58 of the Decree 82/2020/NĐ-CP stipulating child marriage as follows:
1. A fine ranging from VND 1,000,000 to VND 3,000,000 shall be imposed for organizing the marriage for underage persons.
2. A fine ranging from VND 3,000,000 to VND 5,000,000 shall be imposed for maintaining an illegal husband-wife relationship with underage persons even though there is a legally effective judgment or decision of the Court.
Pursuant to Clause 4, Article 4 of the Decree 82/2020/NĐ-CP stipulating the fines as follows:
4. The fines specified in Chapters II, III, IV, V, VI and VII of this Decree shall be applied to administrative violations committed by individuals, except for the articles specified in Clause 5 of this Article. In case the organization commits administrative violations like that of an individual, the fine is 2 times of the fine level imposed on an individual.
Pursuant to Article 183 of the Criminal Code in 2015 stipulating organization of child marriage as follows:
Any person who organizes a marriage entered into by a person under the marriageable age despite the fact that he/she has incurred a administrative penalty for the same offence shall be liable to a fine of from VND 10,000,000 to VND 30,000,000 or face a penalty of up to 02 years' community sentence.
As regulations above, the act of child marriage shall be administratively sanctioned and subject to criminal liability if it is violated again. You should tell your father that child marriage is legally to avoid being punished.
Who has the right to request annulment of child marriage in Vietnam?
Pursuant to Clause 2, Article 10 of the Law on Marriage and Family in 2014 stipulating persons having the right to request annulment of illegal marriage in Vietnam as follows:
2. The following persons, agencies and organizations have, as prescribed by the civil procedure law, the right to request a court to annul an illegal marriage due to violation of Point a, c or d, Clause 1, Article 8 of this Law;
a/ The spouse of a married person who gets married to another person; parent, child, guardian or another at-law representative of a person who gets married illegally;
b/ The state management agency in charge of families;
c/ The state management agency in charge of children;
d/ The women’s union.
