What are latest procedures for registering a marriage in Vietnam?
As prescribed in the Annex issued together with Decision 528/QĐ-BTP in 2023, the guidance on the procedures for registering a marriage in 2023 is carried out in 2 steps as follows:
Step 1: Registering a marriage includes submitting documents in 2 ways:
- Submit directly at the Single Window Division of the People's Committee of the commune where one of the two parties to the marriage resides.
- Submit online by accessing the National Public Service Portal (https://dichvucong.gov.vn), or the Provincial Public Service Portal (https://dichvucong.---.gov.vn).
Step 2: Receiving and processing documents
After the dossier is submitted, the staff at the People's Committee of the commune will receive and carry out the following steps:
Case 1: If the dossier is incomplete or invalid, the staff at the People's Committee of the commune is responsible for notifying the applicant to supplement and complete the dossier.
In case the person registering for marriage does not supplement the dossier, the Head of the One-stop Service Division will announce the refusal to resolve the request to register for marriage.
Case 2: If the dossier is complete and valid, the receiving agency will have an Appointment Slip and return the results to the person registering for marriage.
Note: For the online filing form, the civil servant in charge of household registration will send back an electronic marriage certificate form with full information to the applicant via email or digital device.

What are conditions for getting married in Vietnam?
Pursuant to Article 8 of the Law on Marriage and Family in 2014 stipulating conditions for getting married as follows:
First, the man is full 20 years or older, the woman is full 18 years or older;
Second, the marriage is voluntarily decided by the man and woman;
Third, the man and woman do not lose the civil act capacity;
Fourth, the marriage does not fall into one of the prohibited cases on marriage including:
- Sham marriage or sham divorce;
- Underage marriage, forcing a person into marriage, deceiving a person into marriage, obstructing marriage;
- A married person getting married to or cohabitating as husband and wife with another person, or an unmarried person getting married to or cohabitating as husband and wife with a married person;
- Getting married or cohabitating as husband and wife between people of the same direct blood line; relatives within three generations; adoptive parent and adopted child; or former adoptive parent and adopted child, father-in-law and daughter-in-law, mother-in-law and son-in-law, or stepparent and stepchild;

Rights and obligations between a man and woman cohabiting as husband and wife and their children must comply this Law’s provisions on rights and obligations of parents and children.
Pursuant to Article 71 of the Law on Marriage and Family in 2014 stipulating obligation and right to care for and raise as follows:
Obligation and right to care for and raise
1. Father and mother have equal obligation and right to jointly care for and raise their minor children or adult children who have lost their civil act capacity or have-no working capacity and no property to support themselves.
2. Children have the obligation and right to care for and support their parents, especially when their parents lose their civil act capacity, are sick, become old and weak or have disabilities. For a family with several children, these children shall together care for and support their parents.
As regulations above, father and mother have equal obligation and right to jointly care for and raise their chidlren regardless having married or not.
