Pursuant to the Appendix issued together with Circular 04/2024/TT-BTP which stipulates the application form for marriage registration as follows:

* Instructions on how to complete the application form for marriage registration in Vietnam:
(1) (2) If the marriage registration procedure involves foreign elements, photos of both the male and female parties must be attached.
(3) Clearly state the marriage registration authority.
(4) This should be completed only if the person requesting the civil status registration does not yet have/is unable to provide a personal identification number/citizen identity card/identification card.
If the “Place of residence” information must be provided, record according to the permanent residence; if there is no permanent residence, record according to the temporary residence; if there is neither a permanent nor a temporary residence, record according to the current place of residence.
(5) Record the personal identification number/citizen identity card/identification card (for example: Citizen's identity card No. 025188001010 issued by the Department of Administrative Management on Social Order on November 20, 2021). If there is no personal identification number/citizen identity card/identification card, record the substitute legitimate documents (passport, identity card, etc.).

What are the conditions for getting married in Vietnam?
Pursuant to Article 8 of the Law on Marriage and Family 2014 which stipulates the conditions for getting married in Vietnam:
Article 8. Conditions for getting married
1. A man and a woman wishing to marry must satisfy the following conditions:
a) The male is at least 20 years old, the female is at least 18 years old;
b) The marriage is voluntarily decided by the man and woman;
c) Neither party has lost civil act capacity;
d) The marriage does not fall into one of the cases of prohibited marriage as stipulated in points a, b, c, and d, Clause 2, Article 5 of this Law.
2. The State does not recognize same-sex marriage.
Thus, the conditions for getting married in Vietnam are stipulated as follows:
(1) The male is at least 20 years old, the female is at least 18 years old
(2) The marriage is voluntarily decided by the man and woman
(3) Neither party has lost civil act capacity
(4) The marriage does not fall into one of the following prohibited cases:
- Sham marriage, fake divorce
- Child marriage, forced marriage, deceitful marriage, obstruction of marriage
- A married individual marrying or living like spouses with another person or an unmarried individual marrying or living like spouses with someone who is already married
- Marriage or living like spouses between persons with direct blood line relations; between persons having relations within three generations; between adoptive parents and adopted children; between a former adoptive parent and adopted child, father-in-law with daughter-in-law, mother-in-law with son-in-law, stepfather with stepdaughter, stepmother with stepson.
Note: The State does not recognize same-sex marriage.
Which authority has the competence to register marriage and contents of marriage certificates in Vietnam?
Pursuant to Article 17 of the Law on Civil Status 2014 which stipulates the competence to register marriage and contents of marriage certificates in Vietnam:
Article 17. Competence to register marriage and contents of marriage certificates in Vietnam
1. The People's Committee of the commune where either the male or female party resides performs the marriage registration.
2. The marriage certificate must contain the following information:
a) Full name and middle name; date, month, year of birth; ethnicity; nationality; place of residence; and information on identity documents of both the male and female parties;
b) Date, month, year of marriage registration;
c) Signature or fingerprint of both the male and female parties and certification by the civil status registration authority.
Pursuant to Article 37 of the Law on Civil Status 2014 which stipulates the competence to register marriage in Vietnam:
Article 37. Competence to register marriage
- The District-level People's Committee where the Vietnamese citizen resides performs the marriage registration between Vietnamese citizens and foreigners; between Vietnamese citizens residing domestically and Vietnamese citizens residing abroad; between Vietnamese citizens residing abroad with each other; between Vietnamese citizens with dual nationality and a Vietnamese citizen or foreigner.
- If a foreigner residing in Vietnam requests marriage registration in Vietnam, the District-level People's Committee where either party resides performs the marriage registration.
Thus, the authorities with competence to register marriage in Vietnam are stipulated as follows:
- The People's Committee of the commune where either the male or female party resides performs the marriage registration.
- The District People's Committee has the authority to register marriage in the following cases:
+ A Vietnamese citizen registers marriage with a foreigner;
+ Between Vietnamese citizens residing domestically and those residing abroad;
+ Between Vietnamese citizens residing abroad with each other;
+ Between Vietnamese citizens with dual nationality and either a Vietnamese citizen or a foreigner.
