Under what circumstances is a name removed from the household registration book?
Clause 1, Article 22 of the Law on Residence 2006 stipulates that a person falling into one of the following cases shall have their permanent residence registration revoked:
- Death, declared missing, or declared dead by the court;
- Recruited into the People's Army or People's Police and concentrated in barracks;
- There has been a decision to cancel the permanent residence registration stipulated in Article 37 of this Law;
- Moving abroad to settle permanently;
- Registered permanent residence at a new residence; in this case, the agency that processes the permanent residence registration for a citizen at the new residence is responsible for immediately notifying the agency that issued the household transfer certificate to delete the permanent residence registration at the old residence.
Thus, your case of divorce does not fall into the case of registration deletion. To delete the registration, you must register at another place (your grandmother’s residence).
The conditions for you to register and obtain a permanent residence registration with your paternal grandmother are stipulated at Point d, Clause 2, Article 20 of this Law that an unmarried adult is eligible to live with their paternal or maternal grandparents.
Therefore, you need to complete the divorce procedure with your husband and carry out the household registration procedure with your paternal grandmother.
