What is a Laissez-Passer?

Clause 5, Article 2 of the Law on Exit and Entry of Vietnamese Citizens 2019 defines laissez-passer as:

A laissez-passer is a document issued by competent Vietnamese authorities to Vietnamese citizens to cross borders according to international agreements between Vietnam and countries sharing borders.

What documents are included in the application dossier for a laissez-passer?

Article 5 of Decree 76/2020/ND-CP, amended by point a, clause 1, Article 1 of Decree 67/2024/ND-CP, stipulates that the application dossier for a laissez-passer includes:

(1) 01 fully completed application form in accordance with Form M01a. The application form for the following cases should be handled as follows:

- For persons stipulated in clause 1, point b, clause 2, and point b, clause 3, Article 4 of Decree 76/2020/ND-CP, the application form must be certified and stamped over the photo by the directly managing agency, organization, or enterprise;

- For persons who have lost civil capacity, persons with cognitive difficulties, persons not fully in control of their behavior as stipulated by the Civil Code, and children under 14 years old, the application form should be completed and signed by the legal representative;

- For children under 16 years old applying for a joint laissez-passer for entry and exit at the Vietnam-China border with a parent, the form must be completed and signed by the parent.

(2) 2 passport-sized photos (4cm x 6cm).

For children under 16 years old applying for a joint laissez-passer with a parent, one 3cm x 4cm photo of the child should be attached to the application form, and an additional 3cm x 4cm photo of the child should be submitted to be fixed to the laissez-passer.

(3) Other documents for specific cases:

- 01 copy of the Birth Certificate or an Extract from the birth registration record issued by competent Vietnamese authorities for children under 14 years old who have not been issued a personal identification number; if a photocopy is submitted, the original must be presented for verification;

- 01 certified copy of documents issued by competent Vietnamese authorities proving the legal representative for persons who have lost civil capacity, persons with cognitive difficulties, persons not in full control of their behavior as stipulated by the Civil Code, and children under 14 years old; if a photocopy is submitted, the original must be presented for verification;

- Previously issued laissez-passer, if still valid;

- A letter of introduction from the agency, organization, or enterprise for cases of authorized dossier submission.

Is it possible to authorize the submission of the laissez-passer application dossier?

Article 6 of Decree 76/2020/ND-CP stipulates about authorizing the submission of the laissez-passer application dossier as follows:

Authorization for submission of laissez-passer application dossier

1. Persons working in agencies, organizations, or enterprises with legal personality can authorize those agencies, organizations, or enterprises to submit the application dossier and collect the result on their behalf.

2. In case an enterprise is authorized to submit the application dossier for a laissez-passer, before submission, the enterprise must send to the laissez-passer issuing authority 01 set of legal entity documents, including:

a) 01 certified copy of the decision to establish the enterprise or the business registration certificate; if a photocopy is submitted, the original must be presented for verification;

b) A written introduction of the seal and signature specimens of the legal representative of the enterprise.

3. The submission of legal entity documents as mentioned in clause 2 of this Article is done once, and when there is a change in the content of the dossier, the enterprise sends a supplementary document.

Thus, persons working in agencies, organizations, or enterprises with legal personality can authorize those agencies, organizations, or enterprises to submit the application dossier for the laissez-passer on their behalf.

Note: Decree 67/2024/ND-CP is effective from August 9, 2024.
