Restoration of Vietnamese Nationality after Revocation?
Based on Clause 1, Article 23 of the Nationality Law of Vietnam 2008, the regulation on applying for the restoration of Vietnamese nationality is as follows:
- A person who has lost Vietnamese nationality pursuant to Article 26 of this Law (being deprived of nationality) and has an application for restoration of Vietnamese nationality may be restored to Vietnamese nationality if they fall into one of the following cases:
a) Applying for repatriation to Vietnam;
b) Having a spouse, biological father, biological mother, or biological child who is a Vietnamese citizen;
c) Having made special contributions to the cause of building and defending the Vietnamese Fatherland;
d) Being beneficial to the State of the Socialist Republic of Vietnam;
e) Making investments in Vietnam;
Thus, a person deprived of Vietnamese nationality can still be restored to Vietnamese nationality if they fall into one of the above cases. Note: They cannot be restored to Vietnamese nationality if it is detrimental to the national interests of Vietnam and must wait at least 5 years from the date of deprivation of nationality before being considered for restoration of Vietnamese nationality.
