Request for Certification of Marital Status for Land Sale: Number of Copies Issued?
According to Clauses 3 and 4, Article 12 of Circular 04/2020/TT-BTP, the regulations are as follows:
- In cases where a request is made for the issuance of a Certificate of Marital Status for the purpose of marriage, the civil status registration agency may issue only one (01) copy for the requester. The Certificate of Marital Status must clearly state the full name, year of birth, nationality, and identification documents of the intended spouse, and the place where the marriage registration is expected to take place.
Example: This certificate is issued to complete marriage procedures with Mr. Nguyen Viet K, born in 1962, a Vietnamese citizen, Passport No.: B123456 issued by the Vietnamese Embassy in Germany on February 1, 2020, at the People's Committee of Hoai Duc District, Hanoi City.
This certificate is issued to complete marriage registration procedures with Mr. KIM JONG DOEK, born in 1970, a South Korean citizen, Passport No. HQ12345 issued by the competent authority of South Korea on February 2, 2020, at the competent authority in South Korea, in South Korea.
- In cases where a request is made for the issuance of a Certificate of Marital Status for purposes other than marriage registration, the requester is not required to meet the conditions for marriage; the Certificate of Marital Status must clearly state the purpose of use and has no value for marriage registration. The number of Certificates of Marital Status issued will depend on the request.
Example: This certificate is issued to complete house buying and selling procedures, and has no value for marriage registration.
=> Thus, the law does not stipulate a limit on the number of Certificates of Marital Status issued for purposes other than marriage. The number of Certificates of Marital Status in this case will be issued upon request. In case of issuing a Certificate of Marital Status for the purpose of marriage, only one copy will be issued.
