Relocating to a New Residence Without Transferring Household Registration: Are There Penalties?

Previously, I was registered for permanent residence in Long An. Now, I have moved to my husband's house for 6 months and plan to complete the residence transfer procedures but have not been able to do so yet. I am not sure if I will be fined for exceeding the deadline?

According to Clause 4, Article 22 of the 2020 Law on Residence, which stipulates the procedures for permanent residence registration:

Individuals who have registered for permanent residence but move to another legal residence and meet the conditions for permanent residence registration are responsible for registering for permanent residence at the new residence in accordance with this Law within 12 months from the date they meet the registration conditions.

Thus, within 12 months from the date of changing the legal residence, you must complete the household registration transfer procedure. If this time limit is exceeded, a fine ranging from 100,000 VND to 300,000 VND may be imposed for non-compliance with permanent residence registration regulations (Point a Clause 1 Article 8 of Decree 167/2013/ND-CP).

However, you have not yet exceeded this deadline, so you will not be fined. You can proceed with the procedures to avoid a lapse.
