Relatives visiting for 1 month: Is temporary residence registration required?
According to Article 30 of the 2020 Residence Law on the notification of temporary residence, the regulations are as follows:
When there is a person coming to stay temporarily, a member of the household, a representative of the medical treatment facility, the tourist accommodation establishment, and other facilities with lodging functions are responsible for notifying the residence registration authority of the stay; in the case where an individual or family members are not present at their place of residence when someone comes to stay, the person coming to stay is responsible for notifying the residence registration authority of their stay.
The notification of temporary residence can be done directly, by phone, via electronic means, or other methods as prescribed by the Minister of Public Security.
The content of the temporary residence notification includes full name, personal identification number or ID number, passport number of the person staying; reason for staying; duration of stay; residence address.
The notification of temporary residence must be completed before 11:00 PM on the day the stay begins; in the case where the person arrives after 11:00 PM, the notification must be completed before 8:00 AM the following day; in the case of grandparents, parents, spouses, children, grandchildren, siblings staying multiple times, only a one-time notification is required.
And pursuant to Clause 4 of Article 15 of Circular 55/2021/TT-BCA, the duration of the stay depends on the needs of the citizens but should not exceed 30 days. The person receiving the notification of temporary residence must update the notification contents into the Residential Database.
Thus, in the case where relatives are coming to stay with your family for less than 30 days, there is no need to register for temporary residence; only a notification of temporary residence is required. The form of notification can be done by going directly to or contacting the phone number of the commune or ward police.
