Registering a Child's Birth at a Permanent or Temporary Residence?
According to the provisions of Article 13 of the Law on Civil Status 2014, the People's Committee of the commune where the father or mother's residence is located shall carry out birth registration.
According to the provisions of Article 12 of the Law on Residence 2012, the residence of a citizen is the lawful dwelling place where that person regularly lives. The residence of a citizen may be a permanent residence or a temporary residence.
==> Therefore, you and your spouse have a permanent residence in Ho Chi Minh City. Thus, when your child is born, you can register the birth at the People's Committee of the commune where you temporarily reside without having to return to Tien Giang to register the birth.
According to the provisions of Article 15 of the Law on Civil Status 2014, within 60 days from the date of birth, the father or mother is responsible for registering the birth of the child. In case the father or mother cannot register the birth of the child, the grandfather or grandmother or other relatives or individuals, organizations caring for the child are responsible for registering the birth of the child.
