Procedure for Registering Guardianship Appointment Between Vietnamese Citizens and Foreigners
1. Legal Basis:
- Law on Civil Status 2014;
- Civil Code 2015;
- Circular 85/2019/TT-BTC;
- Circular 04/2020/TT-BTP;
2. Conditions: In cases where a minor or a person who has lost the capacity for civil acts does not have a natural guardian according to the provisions of Article 52 and Article 53 of the Civil Code 2015, the People's Committee of the commune where the ward resides is responsible for appointing a guardian.
3. Documentation: The person requesting the registration of guardianship must submit:
- A guardianship registration application form as prescribed;
- A document appointing a guardian in accordance with the provisions of the Civil Code.
***Note: When carrying out the procedure, the requester must present documents proving their residence to determine the authority for guardianship registration, and personal identification documents: Passport or identity card or citizen identification card...
4. Submission Method: Submit the application directly or by post.
5. Processing Agency: Department of Justice - People's Committee of the district.
6. Processing Time: Within 05 working days from the date of receipt of all required documents.
7. Fees: exempted.
