Procedure for Re-Registration of Birth
*Based on:
- Articles 24, 25, 26 of Decree 123/2015/ND-CP;
- Circular 85/2019/TT-BTC;
- Article 9 of Circular 04/2020/TT-BTP.
*Conditions for Re-registration of Birth Certificates.
- The birth has been registered with a competent Vietnamese authority before January 1, 2016, but both the Birth Register and the original Birth Certificate have been lost.
- The requester is still alive at the time of the re-registration request.
*Dossier:
- A declaration form according to the prescribed format, including a declaration from the requester regarding the birth registration but no retained original Birth Certificate;
- A valid copy of the Birth Certificate issued by a competent Vietnamese authority; The original or a valid copy of documents replacing the Birth Certificate issued before 1945 in the North and before 1975 in the South.
In the absence of these documents, the following valid documents issued by competent Vietnamese authorities can serve as a basis to determine the content for re-registration of birth:
- Identity Card, Citizen Identity Card, or Passport;
- Household registration book, Temporary residence book, documents proving the place of residence;
- Graduation Certificate, Certification, Diploma, Transcript, study records issued or validated by competent authorities;
- Other documents containing information about the individual’s last name, first name, date, month, and year of birth.
Note:
- In case the requester for birth re-registration is an official or public employee, or someone working in the armed forces, in addition to the above-mentioned documents, there must be a written confirmation from the head of the agency or unit regarding the birth details including last name, middle name, first name; gender; date, month, year of birth; ethnicity; nationality; native place; parent-child relationship consistent with the records managed by the agency or unit.
- If the requester’s documents do not provide information proving the parent-child relationship, the civil registration authority must request a competent police authority to verify.
If the police authority responds that there is no information, the civil registration authority will ask the requester to complete a sworn statement regarding the parent's information according to regulations and will determine the birth registration content based on that statement.
*Resolution Time:
- Within 5 working days from the date of receipt of the dossier, the civil status officer verifies the dossier. If the re-registration of the birth is compliant with legal regulations, the civil status officer will proceed with the re-registration.
- If the re-registration is to be done at a commune-level People's Committee different from the initial registration place, the civil status officer will report to the Chairman of the commune-level People's Committee, who then will request the initial registration commune-level People's Committee to verify the local civil register records.
+ Within 5 working days from the date of receiving the request, the initial registration commune-level People's Committee will verify and respond in writing whether the civil register is retained or not.
+ Within 3 working days from the date of receiving the verification result stating that the civil register cannot be retained at the initial registration place, if the dossier is complete, accurate, and complies with legal requirements, the civil status officer will proceed with the re-registration.

- Civil Status Office - Commune-level People's Committee.
*Fee:
=> Determined by the Provincial-level People’s Council.
