Procedure for Birth Registration of Children Born Abroad Returning to Reside in Vietnam
1. Legal basis:
Law on Vietnamese Nationality 2008;
Law on Civil Status 2014;
Decree 123/2015/ND-CP;
Circular 04/2020/TT-BTP.
2. Dossier components:
- Birth registration application form (as per the template);
- Birth certificate or other documents issued by competent foreign authorities confirming the child's birth abroad and mother-child relationship (if available);
- Documents proving the child's residence in Vietnam including: documents proving the child's entry into Vietnam (such as: passport, international travel documents with entry stamp from immigration control authorities) and a confirmation letter from the competent police authority regarding the child's residence in Vietnam.
- Written agreement from the parents on the choice of nationality for the child in accordance with Clause 1, Article 36 of the Law on Civil Status 2014 for cases where the child has one Vietnamese parent and one foreign parent.
In cases where parents choose foreign nationality for the child when registering birth, in addition to the agreement on nationality choice, there must be confirmation from the competent authority of the country in which the child is chosen to hold nationality, affirming that the child has nationality in accordance with that country's legal regulations. If the competent foreign authority does not provide confirmation, the civil status registration authority will register the child's birth but leave the nationality section in the Birth Certificate and Birth Registration Book blank.
The applicant must present the original of one of the following documents: passport, identity card, citizen identification card, or other photo ID and personal information documents issued by competent authorities, still valid for identity verification; documents proving place of residence.
In cases where the child's parents are married, a marriage certificate must be presented.
3. Submission method: direct or authorized.
4. Processing agency: District/County People's Committee where the parents reside.
5. Processing time: Processed immediately on the same day; if the dossier is received after 3 PM and cannot be processed the same day, the result will be provided on the next working day.
6. Fees: Not specifically regulated.
