Procedure for Birth Registration Combined with Registration of Paternity, Maternity, and Child Recognition Involving Foreign Elements

The procedure for the combined registration of birth and recognition of parentage with foreign elements is prescribed in Clause 5, Section 1, Part II of Decision 1872/QD-BTP of 2020. To be specific:

Implementation Procedure

- The applicant for birth registration and recognition of parentage shall submit the application to the competent district-level People's Committee.

- The recipient is responsible for immediately checking the entire dossier, comparing the information in the Declaration Form, and validating the legality of the documents submitted by the requester.

- If the dossier is complete and valid, the recipient provides a receipt, specifying the date and time for the return of the results. If the dossier is incomplete, the recipient will guide the applicant to supplement and complete the dossier as per regulations. If the dossier cannot be supplemented or completed immediately, a written guidance must be provided, clearly stating the types of documents and details to be supplemented, signed with the full name of the recipient.

- The civil status official verifies the recognition of parentage, and posts a notice at the district-level People's Committee office for 07 consecutive days, while also sending a written request to the commune-level People's Committee of the applicant's residence to post the notice for 07 consecutive days at the commune-level People's Committee office.

If the recognition of parentage is correct and non-disputed; the birth information is complete and accurate, the Justice Division reports to the Chairman of the district-level People's Committee. If the Chairman agrees to process the case, he signs the Extract of Recognition of Parentage and the Birth Certificate for the applicant. If the parents choose Vietnamese nationality for the child, the civil status official updates the birth information to issue the personal identification number.

When registering the recognition of parentage, the parties must be present. The civil status official records the registration in the Parentage Register and the Birth Register; guides the requester to check the content of the Birth Certificate, Extract of Recognition of Parentage, Birth Register, and Parentage Register, and has the parties sign the registers.

Method of Implementation:

The applicant for birth registration and recognition of parentage (one or both parties) submits the dossier directly to the competent district-level People's Committee.
