Latest guidelines for filling out the declaration form for death declaration in 2024 in Vietnam

The authority responsible for declaring deaths is specified in the appendix accompanying Circular 04/2024/TT-BTP.

Instructions for filling out the declaration form for death declaration:

(1) Clearly state the name of the declaring authority.

(2) Only fill in this section if the person requesting the declaration does not have or does not provide an individual identification number/citizen identification card/resident card/identity card; or if complete information on the date, month, and year of birth is not provided.

If "Place of residence" information needs to be provided, write according to the registered permanent address; if there is no registered permanent address, write according to the registered temporary address; if there is neither a registered permanent nor temporary address, write according to the current address.

(3) Fill in the individual identification number/citizen identification card/resident card number (e.g., Citizen identification card number 025188001010 issued by the Department of Public Security for Social Order Management and Crime Prevention on November 20, 2021). If there is no individual identification number/citizen identification card/resident card number, write the valid substitute document (passport, identity card, etc.).

(4) If filled in according to the Death Certificate, cross out the phrase "Substitute for the Death Certificate." If filled in with the substitute document number, clearly write the name, document number, and cross out the phrase "Death Certificate." Leave this section blank if not applicable.

(5) Check the box with an X if a copy is requested and specify the number of copies needed.

Which authority is responsible for declaring deaths in Vietnam?

According to Article 32 of the 2014 Law on Civil Status, the authority responsible for declaring deaths is as follows:

Authority for registering deaths

The People's Committee at the commune level where the deceased had their last place of residence is responsible for declaring deaths. In cases where the last place of residence of the deceased cannot be determined, the People's Committee at the commune level where the person died or where the body was found is responsible for declaring deaths.

According to Article 51 of the 2014 Law on Civil Status, the authority responsible for declaring deaths is as follows:

Authority for registering deaths:

1. The People's Committee at the district level where the deceased had their last place of residence is responsible for declaring deaths for foreigners or Vietnamese citizens residing abroad who die in Vietnam.

2. In cases where the last place of residence of the deceased cannot be determined as specified in paragraph 1 of this Article, the People's Committee at the district level where the person died or where the body was found is responsible for declaring deaths.

Depending on each specific case, the authorities responsible for declaring deaths include:

- The People's Committee at the commune level.

- The People's Committee at the district level.

What documents are required for death declaration in Vietnam?

According to Clause 1 Article 34 of the 2014 Law on Civil Status, the procedures for death declaration are as follows:

Death declaration procedures:

1. The person responsible for declaring the death must submit a declaration form according to the prescribed template and the Death Certificate or any other document substituting the Death Certificate to the household registration authority.

2. Upon receiving the documents as specified in Clause 1 of this Article, if the death declaration is deemed accurate, the judicial officer in charge of household registration will record the details of the death in the Household Registration Book. The person declaring the death will also sign the Household Registration Book and report to the Chairman of the People's Committee at the commune level to obtain a certified extract for the person declaring the death.

The judicial officer in charge of household declaration will lock the deceased person's household registration information in the electronic household registration database.

According to Clause 2, Article 4 of Decree 123/2015/ND-CP, the determination of the content for birth and death registration is as follows:

2. When declaring a death according to the provisions of the Law on Household Registration, the death declaration must include the following information: Last name, middle name, first name, and year of birth of the deceased; personal identification number of the deceased, if available; place of death; cause of death; time, date, month, and year of death according to the Gregorian calendar; nationality if the deceased is a foreigner.

The content for death declaration is determined based on the Death Certificate or any other document substituting the Death Certificate issued by the competent authority as follows:

a) For deaths that occur in healthcare facilities, the head of the healthcare facility issues the Death Certificate.

b) For deaths resulting from the execution of the death penalty, the Chairman of the Execution Council issues a certificate confirming the execution of the death penalty instead of the Death Certificate.

c) For individuals declared dead by a court, the court's valid judgment or decision replaces the Death Certificate.

As regulated above, the required documents for death declaration are as follows:

- Death declaration form.

- Death Certificate or any other document substituting the Death Certificate issued by the competent authority as follows:

+ For deaths that occur in healthcare facilities, the head of the healthcare facility issues the Death Certificate.

+ For deaths resulting from the execution of the death penalty, the Chairman of the Execution Council issues a certificate confirming the execution of the death penalty instead of the Death Certificate.

+ For individuals declared dead by a court, the court's valid judgment or decision replaces the Death Certificate.

+ For deaths that occur on transportation vehicles, deaths from accidents, homicides, sudden deaths, or deaths with suspicions, a confirmation document from the police authority or forensic examination results from the Forensic Examination Agency substitutes the Death Certificate.

+ For deaths that do not fall under the above cases, the People's Committee at the commune level where the person died is responsible for issuing the Death Certificate.
