Late Death Registration Fee

My uncle passed away one month ago, and we just went to the commune to register the death. Is this considered late? What is the fee for registering the death in this case?

Clause 1, Article 33, the Civil Status Law 2014, stipulates the time limit for death registration as follows:

Within 15 days from the date of death, the spouse, children, parents or other relatives of the deceased are responsible for registering the death; in cases where the deceased has no relatives, the representative of the relevant agency, organization, or individual is responsible for registering the death.

Thus, in the case where your friend passed away one month before the death registration, it is considered overdue death registration.

* Regarding the fee for overdue death registration:

Point c, Clause 2, Article 5, Circular 85/2019/TT-BTC stipulates the basis for determining the fee and charge rates as follows:

Based on the socio-economic conditions of the locality where the service activities occur, the provincial People's Council stipulates the appropriate fee and charge rates.

For the fees:

Civil status fees are collected from individuals by competent state agencies to resolve civil status matters according to the law; this does not include the issuance of copies of civil status extracts (fees for exploiting and using information in the civil status database as per Circular No. 281/2016/TT-BTC dated November 14, 2016, of the Ministry of Finance).

- Civil status fees for registrations at the commune-level People's Committee, including: Birth registration (including overdue birth registration, re-registration of birth, and birth registration for those with personal dossiers or documents); death registration (including overdue death registration, re-registration of death); marriage (re-registration of marriage); recognition of father, mother, child; changes and corrections to the civil status for those under 14 years old residing domestically; additional civil status for Vietnamese citizens residing domestically; issuance of marriage status certificates; confirmation or entry into the Civil Status Register of other civil status events; other civil status registrations.

- Civil status fees for registrations at the district-level People's Committee, city under provincial authority, centrally-controlled city...

- .....

According to this regulation, the fee for overdue death registration varies by locality. The rates depend on the decision of the provincial People's Council based on the local socio-economic conditions.

Since you did not provide the information about your province, please refer to the decision of your provincial People's Council to know the specific rate.

Sincerely!
