Has there been a new decree regulating electronic identification and authentication in Vietnam? Which entities are issued electronic identification accounts in Vietnam? What information does the electronic identity of foreign individuals in Vietnam contain?

Issuance of Decree 69 on electronic identification and authentication in Vietnam

On June 25th, 2024, the Government issued Decree 69/2024/ND-CP, which came into effect from July 1st, 2024. The Decree regulates the following:

- Detailed regulations on electronic identity.

- Issuance, management, and use of electronic identification accounts.

- Updating and storage of information in the electronic identification and authentication system.

- Conditions and procedures for connecting to the electronic identification and authentication system, electronic authentication services.

- Procedures for issuance, locking, and unlocking of electronic identification cards.

- Responsibilities of relevant agencies, organizations, and individuals regarding electronic identification, authentication, and electronic identification cards.

Under Article 4 of Decree 69/2024/ND-CP, electronic identification and authentication are regulated based on the following principles:

- Compliance with the Constitution and the law, ensuring the legitimate rights and interests of agencies, organizations, and individuals.

- Ensuring accuracy, transparency, and convenience in management for agencies, organizations, and individuals.

- Ensuring security, safety of equipment, and data protection during electronic identification and authentication.

- Entities exploiting and using electronic identities must secure information of electronic identification accounts and comply with the laws on personal data protection.

- Any violation of the laws on electronic identification and authentication must be detected and promptly dealt with according to regulations.

- Compliance with relevant international conventions of which Vietnam is a member.

- Prohibition of the use of electronic identification accounts for activities and transactions that violate the law; infringement upon security, defense, national interests, public interests, and legitimate rights and interests of organizations and individuals.

- Prohibition of any unauthorized interference in the operation of the electronic identification and authentication system by any agency, organization, or individual.

Which entities are issued electronic identification accounts in Vietnam?

Based on Article 7 of Decree 69/2024/ND-CP, the classification and entities eligible for electronic identification accounts are regulated as follows:

Classification and entities eligible for electronic identification accounts:

Vietnamese citizens, organizations, and individuals of foreign nationality residing in Vietnam are eligible for electronic identification accounts as follows:

1. For Vietnamese citizens aged 14 and above who have been issued an identity card or a valid identity card, they are eligible for electronic identification accounts at level 01 and level 02.

Vietnamese citizens aged 6 to under 14 who have been issued an identity card are eligible for electronic identification accounts at level 01 and level 02 when needed. Vietnamese citizens under 6 who have been issued an identity card are eligible for electronic identification accounts at level 01 when needed.

2. For foreigners aged 6 and above who have been issued a permanent residence card or a temporary residence card in Vietnam, they are eligible for electronic identification accounts at level 01 and level 02 when needed. Foreigners under 6 who have been issued a permanent residence card or a temporary residence card in Vietnam are eligible for electronic identification accounts at level 01 when needed.

3. For organizations and institutions established or registered to operate in Vietnam, they are eligible for electronic identification accounts without differentiation by level.

Therefore, electronic identification accounts are issued to the following entities:

- Vietnamese citizens aged 14 and above who have been issued an identity card or a valid identity card: electronic identification accounts at level 01, level 02.

- Vietnamese citizens aged 6 to under 14 who have been issued an identity card: electronic identification accounts at level 01, level 02 when requested.

- Vietnamese citizens under 6 who have been issued an identity card: electronic identification accounts at level 01 when requested.

- Foreigners aged 6 and above who have been issued a permanent residence card or a temporary residence card in Vietnam: electronic identification accounts at level 01, level 02 when requested.

- Foreigners under 6 who have been issued a permanent residence card or a temporary residence card in Vietnam: electronic identification accounts at level 01 when requested.

- Organizations and institutions established or registered to operate in Vietnam: electronic identification accounts without differentiation by level.

What information does the electronic identity of foreign individuals in Vietnam contain?

Based on Article 5 of Decree 69/2024/ND-CP, electronic identity of foreigners includes the following information:

- Foreigner's identification number

- Last name, middle name, and first name

- Date, month, year of birth

- Gender

- Nationality

- Number, code, date, month, year, and place of issuance of passport or internationally recognized travel document

- Facial photograph

- Fingerprints
