According to Article 15 of the 2014 Civil Status Law, birth registration responsibility are stipulated as follows:

1. Within 60 days after the birth of their child, the father or mother shall register the child’s birth; if the parents are unable to register their child’s birth, the grandfather or grandmother or another relative or the individual or organization that is nurturing the child shall register his/her birth.

2. Justice and civil status officers shall regularly examine and urge the birth registration for children in their localities within the prescribed time limit; in case of necessity, mobile birth registration may be made.

Thus, based on the above regulations in Vietnam, within 60 days of giving birth, parents must register the child's birth. If your child was born on July 1, 2022, the latest date to register the birth is August 29, 2022.

Pursuant to Clause 1a, Article 35 of the 2014 Civil Status Law stipulates as follows:

District-level People's Committees of places of residence of fathers or mothers shall register birth for children in the following cases:

1. Children born in Vietnam:

a/ Having a parent being a Vietnamese citizen and the other being a foreigner or a stateless person;

Thus, in the above case, when a child is born in Vietnam and has a Vietnamese father and a foreign mother, it falls under the birth registration authority of the district-level People's Committee.

Pursuant to Point a, Clause 1, Article 3 of the 2014 Civil Status Law, birth registration is related to civil status issues, so your case will be implemented according to the civil status law. Therefore, when extracting a birth certificate, you must follow the procedure for issuing a civil status extract.

Therefore, according to Clause 1, Article 64 of the 2014 Civil Status Law, requesters for issue of civil status extract copies may directly or through representatives send declarations, made according to a set form, to the civil status database-managing agency.

In case a competent agency or organization requests issue of a civil status extract copy of an individual, it shall send a written request clearly stating the reason to the civil status database-managing agency.

And according to Clause 1, Article 2 of Decree 123/2015/ND-CP guiding the civil status law, an applicant for civil status registration or issuance of copies of civil status documents shall present the original of one of the following documents: passport, ID card, or another document containing photo and personal information that has been issued by a competent authority and remaining valid (hereinafter referred to as identity paper) for the identity verification purpose.

In the transitional stage, the applicant for civil status registration shall present documents proving his/her place of residence.

Therefore, according to the above regulations in Vietnam, you have met the documents presented as proof of identity. In addition, you need to have an additional declaration applying for a birth certificate extract copy according to the prescribed form, and submit it to the Civil Status Database Management Agency to receive a copy of the birth certificate extract.
