Is it possible to apply for a Certificate of Marital Status for father or mother?
As stipulated in Clause 2, Article 2 of Circular 04/2020/TT-BTP on the authorization of civil status registration, it states:
The requester for the issuance of civil status extract copies, issuance of marital status confirmation, and requests for civil status registration as stipulated in Article 3 of the Law on Civil Status (hereinafter referred to as civil status registration requests) can authorize another person to execute; except in cases of marriage registration, re-registration of marriage, and registration of parent-child relationships wherein authorization to another person is not permissible, but one party can directly submit the application at the competent civil status registration authority without requiring a written authorization from the other party.
The authorization must be made in writing and authenticated according to legal regulations. In cases where the authorized person is a grandfather, grandmother, father, mother, child, spouse, sibling of the authorizer, the written authorization is not required to be authenticated. Hence, according to the above regulations, a child is authorized to request the issuance of a marital status confirmation for their father or mother. However, authorization documentation is required, although this does not need to be authenticated.
Sincerely.
