Is it permissible to mortgage citizen identity cards in Vietnam?

Pursuant to Clause 7 Article 7 of the Law on Citizen Identification in 2014 stipulating as follows:

Forging, modifying and falsifying contents of citizen identity cards; appropriating or illegally using citizen identity cards of other persons; renting, leasing, boưowing, lending, mortgaging, receiving as mortgage or destroying citizen identity cards; or using forged citizen identity cards.

As regulations above, mortgaging, or receiving as mortgage citizen identity cards are prohibited by the law.

What are the fines for mortgaging citizen identity cards in Vietnam?

Pursuant to Clause 4 Article 10 of the Decree 144/2021/NĐ-CP, a fine ranging from 4.000.000 VND to 6.000.000 VND shall be imposed for any of the following violations:

a) Forging the ID card or citizen identity card or ID number certificate; but not liable to criminal prosecution;

b) Using a forged ID card or citizen identity card or ID number certificate;

c) Pledging the ID card or citizen identity card or ID number certificate, or receiving them as pledge;

d) Buying, selling, taking or granting lease of the ID card or citizen identity card or ID number certificate;

dd) Borrowing, lending the ID card or citizen identity card or ID number certificate for commission of illegal acts.

As regulations above, the act of mortgaging citizen identity cards in Vietnam shall be fined from 4.000.000 VND to 6.000.000 VND. In addition, the money that the violator obtains from such mortgages shall be confisticated.
