Is it permissible to board the plane without ID cards in Vietnam?

Under Appendix 14 issued with Circular 13/2019/TT-BGTVT (amended by Appendix 7 of Circular 42/2023/TT-BGTVT), it is stated that if there is no ID cards, individuals can still travel by plane by replacing it with the following documents:

(1) For international flights:

Passport or travel document or valid laissez-passers as regulated by law such as exit visas, permanent residence cards, temporary residence cards;

In case a child does not have their own passport, their full name, date of birth, and photo are recorded and affixed to the passport of their legal representative according to the law, including biological parents, adoptive parents, or guardians.

(2) Passengers aged 14 and above when going through domestic flight procedures must present one of the following types of documents or equivalent legal electronic data:

- For passengers with foreign nationality:

+ Passport (with the latest immigration stamp) or travel document with the latest immigration stamp and relevant residence documents in Vietnam (visa, permanent residence card, temporary residence card, APEC business travel card), except for cases exempted from visas; diplomatic identification card issued by the Ministry of Foreign Affairs for members of diplomatic missions, consular offices, or representative offices of international organizations;

+ Driver's license for cars or motorcycles; airport security control card of long-term validity;

+ Identification card of Vietnamese airlines;

+ Level 2 electronic identification account of the passenger.

In case a passenger loses their passport, they must have a diplomatic note from the diplomatic or consular agency of the passenger's nationality or an official letter from the foreign affairs department (with confirmation from the local police agency where the passenger lost their passport) confirming the passenger's identity and the loss of their passport, with a photo and a stamped seal.

The diplomatic note or official letter is valid for 30 days from the date of confirmation;

- For passengers with Vietnamese nationality, they must present one of the following types of documents:

+ Passport or travel documentor exit visa, permanent residence card, temporary residence card, identification card; identification or certification by the people's police or people's military;

+ National Assembly delegate card; Party member card; Journalist card; driver's license for cars or motorcycles; card of the National Civil Aviation Security Committee; airport security control card of long-term validity; identification card of Vietnamese airlines;

+ Level 2 electronic identification account of the passenger; identity confirmation paper certified by the police agency (the confirmation paper includes the following information: confirming agency, confirming person; date of confirmation; full name, date of birth, gender, place of residence of the confirmed person; reason for confirmation.

The confirmation paper must have a photo, a sealed stamp, and is valid for 30 days from the date of confirmation); confirmation paper from the authorized agency certifying that the passenger has just completed serving a sentence.

- Passengers with Vietnamese nationality aged 14 to under 20 and not exceeding 20 days can use the same types of travel documents as passengers under 14 years old for air travel.

(3) Passengers under 14 years old when going through domestic flight procedures must present one of the following types of documents:

- Birth certificate; household registration record; extract of birth certificate (extract of birth information); document confirming household registration information; in case of being under 2 months old and not having a birth certificate, a birth confirmation document is required;

Level 2 electronic identification account of the passenger; personal information of the passenger in the Level 2 electronic identification account of the father or mother or accompanying guardian.

- Confirmation document from a social organization for children being fostered by the social organization (valid for 6 months from the date of confirmation).

- Identity confirmation paper certified by the police agency (the confirmation paper includes the following information:

+ Confirming agency, confirming person;

+ Date of confirmation; full name, date of birth, gender, place of residence of the confirmed person;

+ Reason for confirmation.

The confirmation paper is valid for 30 days from the date of confirmation).

- Citizen Identification Card, passport (separate passport or accompanied by parent's passport).

(4) Passengers who are prisoners, suspects, individuals under escort or deportation, when going through flight procedures, only need to have documents from the competent authority proving their escort; passengers escorting them must present the types of documents specified in (1) and (2).

(5) The documents used by passengers when traveling by plane must meet the following conditions:

- Original and valid; or electronic document with legal validity as prescribed;

- For birth certificate, household registration record, extract of birth certificate (extract of birth information), document confirming household registration information, birth certificate must be original or certified copy as prescribed by law; or electronic document with legal validity as prescribed;

- Documents specified in (1), (2), (3), (4) will not be accepted if they do not have a photo or the photo does not comply with the regulations of the law, except for birth certificate, birth confirmation document, household registration record, extract of birth certificate, document confirming household registration information, documents from the competent authority proving the escort.

- If it is a Level 2 electronic identification account, the electronic birth certificate of the passenger must ensure that the account is functioning normally when presented.

(6) At ticket selling points for passengers and during aviation procedures and on the airline's website, regulations on passengers' personal information to be declared when purchasing air tickets and the types of personal identification documents used by passengers when traveling by plane must be publicly posted.

What are rights of passengers when traveling by planes in Vietnam?

Pursuant to Article 147 of the Law on Vietnam Civil Aviation in 2006 (amended by Clause 39 Article 1 of the Law on amendments to the Law on Vietnam Civil Aviation in 2014) stipulating rights of passengers when traveling by planes in Vietnam as follows:

- To be informed in writing of the limits of the carrier's liability for damage sustained in case of death or injury of a passenger, damage to or loss of baggage, and delay.

- If a passenger cannot be carried due to the carrier's fault, the passenger is entitled to request the carrier to arrange an appropriate journey or refund the unused portion of the fare.

- In the cases specified in Article 146 of this Law, passengers are entitled to receive back their fare or an amount of money equivalent to the unused portion of the fare after subtraction of a charge and fine as stipulated in the carriage rules.

- To refuse to take the flight; during the journey the passenger is entitled to refuse to continue taking the flight at any airport, airfield or a place of forced landing, and he/she is entitled to receive back the fare or an amount of money equivalent to the unused portion of the fare after subtraction of a charge and fine as stipulated in the carriage rules.

- To be exempt from the baggage service price within the minimum limit stipulated in the carriage rules.

- Children under twelve years of age going by aircraft are entitled to fare exemption or reduction at the level stipulated in the carriage rules.

Children between two and under twelve years of age shall be arranged separate seats; under-two children do not have a separate seat and must be accompanied by adults.

What are obligations of passengers when traveling by planes in Vietnam?

Pursuant to Article 148 of the Law on Vietnam Civil Aviation in 2006 stipulating obligations of passengers when traveling by planes in Vietnam as follows:

- To observe regulations on assurance of aviation safety and security.

- To comply with instructions of the carrier during the journey.

- To pay compensations for damage caused due to their fault to the carrier or aircraft operator.

Note: Circular 42/2023/TT-BGTVT takes effect on February 15th 2024.
