Is it necessary to register a death certificate for a child born alive for less than 24 hours if a birth certificate has already been issued? What are the procedures for registering a death certificate?

Translation:

If a child born alive but lives for less than 24 hours and has a birth certificate, is a death certificate also required? What are the procedures for registering a death certificate? My brother and sister-in-law just had their first child, so our family registered the child's birth immediately after the child was born. However, due to certain reasons, the child passed away on the same day. I would like to ask if our family has already registered the birth certificate, do we need to register a death certificate? The child lived for less than 24 hours. If required, what are the procedures to follow?

Must a child born alive for less than 24 hours be registered for both birth and death?

Based on Article 30 of the Civil Code 2015 regarding the rights to birth and death registration as follows:

  1. An individual has the right to be registered at birth from the moment of birth.

  2. An individual must be registered at death.

  3. A child born alive for 24 hours or more and then dies must be registered for both birth and death; if born alive for less than 24 hours, there is no requirement to register for either birth or death, unless requested by the biological father or mother.

  4. Birth and death registration is regulated by civil status law.

Thus, according to current regulations, in the event that a child born alive for less than 24 hours has died, no birth or death registration is required unless requested by the biological parents. However, if you have already registered the birth for the child, you will need to complete the death registration.

What are the procedures for death registration?

According to Article 52 of the Law on Civil Status 2014, the procedures for death registration are as follows:

  1. The person registering the death submits the prescribed declaration and Death Notice or other documents substituting the Death Notice to the civil status registration agency.

  2. Immediately after receiving the full documents as prescribed in Clause 1 of this Article, if the death registration is valid, the official handling civil status will record it in the Civil Status Register and sign alongside the person registering the death. The Department of Justice reports to the Chairman of the District-level People's Committee to issue an extract of the civil status for the person registering the death.

In case verification is needed, the time limit for resolution is not more than 03 working days.

  1. After registering the death, the District-level People's Committee must notify the Ministry of Foreign Affairs in writing, accompanied by the civil status extract, to notify the competent authority of the country of which the deceased was a citizen.

In the case of a deceased Vietnamese citizen residing abroad, the official handling civil status updates the information of the deceased in the electronic civil status database.

** You or a family member must register the child's death according to the above regulations.**

Respectfully!
