Is it necessary to present marriage certificate when registering for birth certificate in Vietnam?
On February 4, 2025, the Ministry of Justice issued Official Dispatch 481/BTP-HTQTCT in 2025 on implementation of the provisions of Decree 07/2025/ND-CP:
On January 9, 2025, the Government of Vietnam issued Decree No. 07/2025/ND-CP amending and supplementing several provisions of the Decrees in the field of civil status, nationality, and authentication. This Decree takes effect from the date of signing, and the Ministry of Justice has issued a Decision announcing the administrative procedures amended and supplemented in the fields of civil status, nationality, and authentication[1].
To implement uniformly the provisions of Decree No. 07/2025/ND-CP, the Ministry of Justice requests the People's Committees of provinces and centrally-run cities to pay attention to implementing the following contents:
- Direct the Department of Justice to cooperate with relevant Departments and sectors to disseminate and thoroughly understand the contents of Decree No. 07/2025/ND-CP to the relevant agencies, organizations, and individuals, focusing on noting a few contents:
- When receiving the request for birth registration, the civil status registration agency does not require the presentation of the Marriage Certificate of the child's parents (if the child's parents have registered their marriage, except in cases where the child's parents are foreigners); when receiving a request for marriage registration, the civil status registration agency does not require the submission of a Marital Status Confirmation, Divorce Record Extract (for Vietnamese citizens) but searches for information about the marital status of the child's parents, searches information about the marital status of the person requesting marriage registration in the provincial-level Administrative Procedure Resolution Information System through a connection with the electronic civil status database, national population database. If the marital status information is unavailable in the Database, the civil status registration agency shall verify according to the provisions at point c, clause 3, Article 2 of Decree No. 07/2025/ND-CP.

What does birth registration in Vietnam include?
Pursuant to Article 14 of the Law on Civil Status 2014 on the contents of birth registration:
Article 14. Contents of Birth Registration
- Birth registration includes:
a) Information of the person being registered: Full name, middle name, and name; gender; date of birth; place of birth; place of origin; ethnicity; nationality;
b) Information of the parents of the person being registered: Full name, middle name, and name; year of birth; ethnicity; nationality; place of residence;
c) Personal identification number of the person being registered.
- The determination of nationality, ethnicity, family name of the person being registered follows the provisions of Vietnamese nationality law and civil law.
- The contents of birth registration as stipulated in clause 1 of this Article are basic civil status information of individuals, recorded in the civil status Book, Birth Certificate, updated in the electronic civil status database, and the national population database. The individual's records and documents related to birth information must conform to that person's birth registration contents.
The Government of Vietnam regulates the issuance of personal identification numbers for those being registered.
According to the above provisions, birth registration includes the following contents:
- Information of the person being registered: Full name, middle name, and name; gender; date of birth; place of birth; place of origin; ethnicity; nationality
- Information of the parents of the person being registered: Full name, middle name, and name; year of birth; ethnicity; nationality; place of residence
- Personal identification number of the person being registered
What are details of the latest birth registration declaration form in Vietnam in 2025?
Based on the Appendix issued together with Circular 04/2024/TT-BTP stipulating the birth registration declaration form:

Notes:
(1) Clearly state the name of the birth registration agency.
(2) Only record if the person requesting civil status registration does not have/provide a personal identification number/citizen identity card/citizen card/identity card; does not provide full information about the date, month, year of birth.
In case it is necessary to provide "Place of residence" information, record it according to the permanent residence registration; if there is no permanent residence registration, record it according to the temporary residence registration; if there is no permanent residence or temporary residence registration, record the current place of residence.
(3) Record the personal identification number/citizen identity card/citizen card (e.g., Citizen identity card No. 025188001010 issued by the Department of Administrative Management on Social Order dated November 20, 2021). If there is no personal identification number/citizen identity card/citizen card, record replacement documents (passport, identity card,...).
(4) If born in a medical facility, clearly state the name and address of that medical facility.
Example: - Hanoi Maternity Hospital, La Thanh Street, Ngoc Khanh Ward, Ba Dinh District, Hanoi.
- Dinh Bang Commune Health Station, Tu Son District, Bac Ninh Province.
If born outside a medical facility, record the location of 03 administrative levels (commune, district, province) where birth occurred.
Example: Dinh Bang Commune, Tu Son District, Bac Ninh Province.
(5) Clearly record the full date and month of birth of the parents (if any).
(6) Please mark X in the box if a copy is requested and note the quantity.
