Is Divorce Recorded in the Certificate of Single Status?
Clause 1, Article 33 of Circular 04/2020/TT-BTP stipulates the method of recording the Certificate of Marital Status as follows:
The section “Marital Status” must honestly state the current marital status of the person. To be specific:
- If never married, it should clearly state that currently not registered for marriage with anyone.
- If currently married, it should clearly state that is currently married to Mr./Mrs. ... (Marriage Certificate No. ..., issued by ... on Month ... Day ... Year ...).
- If living together as husband and wife before January 3, 1987, and not divorced or there is no event of the wife (husband) dying or being declared dead, it should clearly state that is currently having a husband/wife who is Mr./Mrs. ....
- If registered for marriage or living together as husband and wife before January 3, 1987, but has divorced and has not remarried, it should clearly state that has registered for marriage or had a husband/wife, but has divorced according to Divorce Judgment/Decision No. ... on Month ... Day ... Year ... of the People's Court ...; currently not registered for marriage with anyone.
- If registered for marriage or living together as husband and wife before January 3, 1987, but the spouse has died and has not remarried, it should clearly state that has registered for marriage or had a husband/wife, but the husband/wife has died (Death Certificate/Death Extract/Judgment No.: ... issued by ... on Month ... Day ... Year ...); currently not registered for marriage with anyone.
- If a person currently married requests confirmation of marital status during the period before the marriage registration, it should clearly state that during the period from Month ... Day ... Year ... to Month ... Day ... Year ... not registered for marriage with anyone; currently married to Mr./Mrs. ... (Marriage Certificate No. ..., issued by ... on Month ... Day ... Year ...).
If divorced, it will state "had a wife, but divorced according to Divorce Judgment/Decision No. ... on Month ... Day ... Year ... of the People's Court ...; currently not registered for marriage with anyone".
Therefore, if you are divorced, when applying for a certificate of marital status, you must still record the information that you have been divorced.
