Is a death certificate needed to revise residence information when my husband who is a household head dies in Vietnam? What are procedures for revision of residence information in Vietnam? 

Hello, my husband is the household head but passed away not long ago. Now, to revise the residence information, my child can easily apply for school, but the commune requires the husband's death certificate. Is it correct to do the revision procedure? Please ask for answers.

Pursuant to Article 10 of Circular 55/2021/TT-BCA regulating revision of residence information in residence database as follows:

1. In case of change of household head, the household head to be replaced must give their consent in the declaration of change to residence information (unless they have given their consent in writing) or household head election agreement of household members or document deciding household head of the Court must be provided. In case the household head is deceased or missing or lacks legal capacity, besides household head election agreement of household members, a death certificate or the Court’s decision declaring that the household head is deceased or missing or lacks legal capacity must be provided.

2. In case of change to civil status information compared to information in the residence database, documentary proof of permission for such change from the competent civil registration authority must be provided. If information on the change is already available in the electronic civil status database, such documentary proof is not required.

3. In case of change to address of place of residence due to change to administrative unit boundaries, administrative unit name, name of street, neighborhood, village, commune or hamlet, or house number, the competent residence management authority shall update the address in the residence database based on the document on change to administrative unit boundaries, administrative unit name, name of street, neighborhood, village, commune or hamlet, or house number from the competent authority.

Thus, when your family changes information about their place of residence, it is necessary to have your husband's death certificate in the file, and there must also be a document on the unanimous nomination of household members to carry out procedures to adjust information about place of residence in Vietnam.

What are procedures for revision of residence information in Vietnam? 

According to Clause 3, Article 26 of the Residence Law 2020, procedures for revision of residence information are prescribed as follows:

3. Procedure for revision of residence information:

a) For the case in Point a Clause 1 herein, a household member shall submit an application containing the documents mentioned in Clause 2 herein to the registration authority. Within 03 working days starting from the date of receipt of an adequate and valid application, the registration authority shall revise information on the household head in the residence database and notify the applicant of such revision; and provide a written explanation for the applicant if the application rejected;

b) For the case in Point b Clause 1 herein, within 30 days starting from the date of issuance of a decision on change to civil status information by the competent authority, the person subject to such change shall submit an application for revision of relevant information in the residence database containing the documents mentioned in Clause 2 herein to the registration authority.

Within 03 working days starting from the date of receipt of an adequate and valid application, the registration authority shall revise civil status information in the residence database and notify the applicant of such revision; and provide a written explanation for the applicant if the application rejected;

c) For the case in Point c Clause 1 herein, registration authorities shall revise the information in the residence database.

In Clause 2, Article 26 of the Residence Law 2020, documents are stipulated as follows:

2. Application for revision of residence information for the cases in Points a and b Clause 1 of this Article includes:

a) Declaration of change to residence information;

b) Written proof of the change.

According to this Article, your family needs to prepare documents and carry out the above procedures to revise information about your place of residence in Vietnam.
