In Which Cases is the Personal Identification Number on the Birth Certificate Cancelled?
At Article 6 of Circular 59/2021/TT-BCA guiding Decree 137/2015/ND-CP, it is stipulated as follows:
- In the case of re-establishing a personal identification number when the citizen has been re-identified in terms of gender or has corrected the year of birth according to the regulations of the law on civil registration, the police of the commune where the citizen is permanently registered shall require the citizen to provide papers and documents proving the re-identification of gender or the correction of the year of birth for examination, verification, supplementation into the management file, and send a request for the re-establishment of the personal identification number for the citizen to the agency managing the National Database on Population of the Ministry of Public Security.
- In the case of canceling a personal identification number already established for a citizen due to errors in the process of entering data related to information on the place of birth registration, year of birth, or gender of the citizen into the National Database on Population, the police of the commune where the citizen is permanently registered shall check, verify the accuracy of the information to be adjusted, and send a request for cancellation and re-establishment of the personal identification number for the citizen to the agency managing the National Database on Population of the Ministry of Public Security.
- The Head of the agency managing the National Database on Population of the Ministry of Public Security is responsible for considering and deciding on the cancellation and re-establishment of the personal identification number for the citizen in the cases stipulated at Clause 1 and Clause 2 of this Article. After deciding on the cancellation and re-establishment of the personal identification number for the citizen, the agency managing the National Database on Population of the Ministry of Public Security must update the new personal identification number for the citizen into the National Database on Population. The canceled personal identification number will be stored in the citizen's information data in the National Database on Population and shall not be used to issue to any other citizen.
- The police of the commune where the citizen is permanently registered shall send a written notification to the citizen about the newly re-established personal identification number.
- The Public Security agency that receives the request for issuing a Citizen's Identity Card shall use the newly re-established personal identification number in the National Database on Population to perform the issuance of the Citizen's Identity Card according to the regulations.
=> Thus, the personal identification number already issued to a citizen will be canceled in case of errors when entering data related to information on the place of birth registration. The authority to cancel the personal identification number belongs to the Head of the agency managing the National Database on Population of the Ministry of Public Security.
