Pursuant to Clause 1, Article 229 of the Civil Code 2015, the establishment of ownership rights for buried, hidden, submerged, or sunken assets found is regulated as follows:

  1. The person who discovers buried, hidden, submerged, or sunken assets must immediately notify or return them to the owner; if the owner is unknown, the discovery must be reported or handed over to the nearest commune-level People's Committee, commune-level police, or other competent state authorities as prescribed by law.

Based on the current regulation, in the case where you cannot determine the owner of the unearthed gold, you must notify or submit it to the nearest commune-level People's Committee, commune-level police, or other competent state authority as prescribed by law.

Clause 2, Article 229 of the Civil Code 2015 regulates the establishment of ownership rights for buried, hidden, submerged, or sunken assets found as follows:

  1. Buried, hidden, submerged, or sunken assets found without an identifiable owner shall, after deducting the search and preservation costs, have ownership determined as follows:

a) If the found asset is classified as a cultural or historical relic according to the provisions of the Law on Cultural Heritage, it belongs to the State; the finder of such asset is entitled to a reward according to legal regulations;

b) If the found asset is not classified as a cultural or historical relic according to the provisions of the Law on Cultural Heritage and has a value less than or equal to ten times the statutory pay rate set by the State, it belongs to the finder; if the found asset has a value greater than ten times the statutory pay rate set by the State, the finder is entitled to an amount equal to ten times the statutory pay rate set by the State and 50% of the value exceeding ten times the statutory pay rate set by the State, the remaining value belongs to the State.

If an artifact is dug up in your garden, the artifact will belong to the State.
