Hello Lawnet. My child was born abroad and we have already registered his/her birth there. Now, we are back to Vietnam to live. We want our child to have a personal identification number and documents to go to school in Vietnam. We are both Vietnamese citizens, do we need to register the birth again for our child?

Pursuant to Article 22 of the Circular 04/2020/TT-BTP stipulating recording vital events of Vietnamese citizens resolved by competent foreign authorities in civil registers as follows:
1. If a Vietnamese citizen born overseas and having their birth registered at the competent foreign authority wishes to have their birth recorded in the civil registers, the civil registration authority shall record their birth in the civil register and issue an extract of the birth registration recorded in the civil register and a copy of the birth certificate to the applicant.
2. If a Vietnamese citizen not residing in Vietnam wishes to have their divorce recorded in the civil register so as to register their new marriage at the competent Vietnamese authority, they shall submit an application to the People's Committee of the district where they registered their previous marriage or where they register their new marriage.
Pursuant to Clause 1 Article 29 of the Circular 04/2020/TT-BTP stipulating ways to fill in civil registers and civil status documents as folloows:
1. Commune-level officials in charge of justice - civil status affairs, officials in charge of civil status affairs of district-level justice authorities, and members of diplomatic missions and consular posts (hereinafter collectively referred to as “civil status officials”) shall accurately fill in civil registers and civil status documents themselves with clear handwriting, no acronyms or erasing; using quality ink of one color; and avoiding using different ink colors and red ink.
Civil status documents printed using information technology must be printed with quality black ink and ensure that the letters are not blurry, missing strokes or fading.
In your child's case, you will not need to complete additional procedures to register the child's birth in Vietnam. You only need to go to the People's Committee at the district level (Office of Justice) to complete the procedures to record the fact that your child's birth was registered abroad in the Civil Registry.

Can the name of the child on the birth certificate in Vietnam be corrected?
Pursuant to Article 24 of the Decree 123/2015/NĐ-CP stipulating conditions for birth, marriage or death re-registration as follows:
1. Any birth, marriage, or death registration that has been granted at the competent authority of Vietnam before January 1, 2016 but the vital records or originals copies from vital records are lost shall be eligible for re-registration.
2. An applicant for birth, marriage, or death re-registration shall submit sufficient copies of relevant documents.
3. The birth or marriage re-registration is only granted if the applicants are still alive at the time of receiving application.
According to the above regulations, re-registration of birth will only be carried out when you lose your birth certificate, so in the case of incorrect information, you cannot apply for a new birth certificate.
What are regulations on validity of birth certificate in Vietnam?
Pursuant to Article 6 of the Decree 123/2015/NĐ-CP stipulating validity of birth certificate in Vietnam as follows:
1. Birth certificate is an original document on civil status of an individual.
2. All documents of an individual containing full name, date of birth, race, nationality, native place, parent-child relationship shall be consistent with his/her birth certificate.
3. If an individual’s document contains information different from his/her birth certificate, the head of agency that has managed or issued such document shall make appropriate amendments in accordance with the birth certificate.
Therefore, a birth certificate is a person's original document on civil status, is the basic civil status information of the person and is the basis for identifying the information of an individual on all types of documents related to personal identity.
