How Much Is the Penalty if Parents Visiting from the Countryside Do Not Declare Temporary Residence?
Pursuant to Article 31 of the 2006 Law on Residence, amended and supplemented by Clause 5, Article 1 of the Amended Law on Residence 2013, it is stipulated that:
- Temporary residence is when a citizen stays for a certain period of time at a location in a ward, commune-level town other than their place of residence and does not fall under the case requiring temporary registration.
- Heads of households, collective housing, medical facilities, hotels, guesthouses, and other establishments with people coming to stay temporarily are responsible for notifying the ward, commune-level town police about the temporary residence. In cases where the individual comes to stay temporarily at a family house or collective housing where the head of the household or collective housing is not permanently registered in that ward, commune-level town, then the individual staying temporarily is responsible for notifying the ward, commune-level town police about the temporary residence. Such notification may be made directly, by telephone, or via the Internet or computer networks. The ward, commune-level town police are responsible for announcing the location, internet address, computer network address, and telephone number for receiving temporary residence notifications to the public.
- The notification of temporary residence should be made before 11 pm, and if the person comes to stay after 11 pm, the notification should be made the following morning. In the case of grandparents, parents, spouse, children, grandchildren, siblings coming to stay multiple times, notification of temporary residence is only required once.
According to Clause 1, Article 8 of Decree 167/2013/ND-CP, it is stipulated:
A fine ranging from VND 100,000 to VND 300,000 shall be imposed for one of the following acts:
- Individuals, heads of households failing to comply with the notification of temporary residence or declaration of temporary absence;
- ...
=> Thus, according to the above regulation, if your parents come to visit from the countryside, you are also responsible for notifying their temporary residence. Therefore, the ward police’s imposition of a VND 200,000 fine on you is in accordance with the law.
