How much is intercountry adoption registration fee in Vietnam?
I know that the adoption registration fee includes: domestic adoption registration fee, foreign adoption registration fee and adoption registration fee at overseas Vietnamese representative missions. So let me ask: According to current regulations, how much is the registration fee for foreign adoption?
Answer: According to the current law in Clause 1, Article 12 of the Law on Adoption 2010, the adopter must pay the adoption registration fee. The fee for adoption registration is determined to include:
- Domestic adoption registration fee.
- Foreign adoption registration fee.
- Adoption registration fee at overseas Vietnamese representative missions.
In which, the foreign adoption registration fee is the fee collected for the case where the Vietnamese people residing abroad, the foreigners permanently residing abroad, the foreigners permanently residing in Vietnam adopt the children. Vietnamese citizen; foreigners residing in border areas of neighboring countries adopt Vietnamese children permanently residing in border areas of Vietnam.
According to the provisions of Clauses 2, 3 and 4, Article 3 of Decree 141/2016/ND-CP:

A Vietnamese person residing in a foreign country or a foreigner permanently residing in a foreign country that adopts a child being Vietnamese national shall pay an amount of intercountry adoption registration fee as prescribed in Point b Clause 1 Article 6 of this Decree upon the submission of application for adoption registration at Adoption Department of the Ministry of Justice.
3. A foreigner permanently residing in Vietnam that adopts a child being Vietnamese national permanently residing in Vietnam shall pay an amount of adoption registration fee as prescribed in Point c Clause 1 Article 6 of this Decree upon the submission of application for adoption registration at the Ministry of Justice.
4. A foreigner residing in a border region of a neighbor country that adopts a Vietnamese child permanently residing in such border region of Vietnam shall pay an amount of adoption registration fee as prescribed in Point d Clause 1 Article 6 of this Decree upon the submission of application for adoption registration at a People’s Committee of commune.
According to the provisions of Clause 1, Article 6 of Decree 141/2016/ND-CP, the specific foreign adoption registration fee rates are as follows:
1. Amounts of adoption registration fees:
a) Amount of domestic adoption registration fee: VND 400,000/case.
b) Amount of adoption registration fee collected from Vietnamese people residing in foreign countries or foreigners permanently residing in foreign countries that adopt children being Vietnam nationals: VND 9.000.000/case.
c) Amount of fee collected from foreigners permanently residing in Vietnam that adopt children being Vietnamese nationals: VND 4.500.000/case.
d) Amount of fee collected from foreigners residing in border regions of neighbor countries that adopt Vietnamese children permanently residing in such border regions: VND 4.500.000/case.
dd) Amount of adoption registration fee at Vietnam’s overseas representative bodies: USD 150/case. The above fee shall be converted into the receiving country’s currency according to the selling rate of USD announced by a bank where the Vietnam’s overseas representative body open its account.
In addition to the registration fee for foreign adoption, a foreigner who is not permanently residing in Vietnam who adopts a child in Vietnam must pay a sum of money to offset part of the cost of foreign adoption settlement, including: including expenses for raising, caring for and educating children from the time they are introduced for adoption to the completion of the procedures for handover and adoption, verification of the origin of the introduced person, child delivery and adoption, and reasonable remuneration for the staff of the institution.
Collecting bodies
1. People’s Committees of communes shall collect domestic adoption registration fees and fees collected from foreigners residing in border regions of neighbor countries that adopt Vietnamese children permanently residing in such border regions.
2. Services of Justice shall collect fees from foreigners permanently residing in Vietnam that adopt children being Vietnamese nationals.
3. Adoption Department of the Ministry of Justice shall collect intercountry adoption registration fees, excluding regulations in Clause 1 and Clause 2 of this Article; and fees for issuance or extension of operation licenses of intercountry adoption agencies.
4. Vietnam’s overseas representative bodies shall collect adoption registration fees at Vietnam’s overseas representative bodies.
Intercountry adoption registration fees shall be deducted in one of the following cases:
a) A reduction of 50% in intercountry adoption registration fee shall apply to a stepfather or stepmother that adopts a stepchild of his/her spouse or an aunt or uncle that adopts a niece or nephew;
b) In case of simultaneously multiple adoption of biological brothers/sisters, a reduction of 50% in intercountry adoption fee shall apply to each of children excluding the first child;
c) In case of adoption falling into the both aforesaid cases prescribed in Point a and Point b of this Clause, the payer may select to apply the reduction in fees prescribed in either of those Points.

Answer: Foreigners permanently residing in Vietnam adopt children specified in Article 41 of the Law on Adoption 2010, specifically as follows:
1. Articles 14. 15. 16, 17, 18. 21, 23, 24. 25, 26 and 27 of this Law are applicable to foreigners permanently residing in Vietnam and seeking to adopt a child in Vietnam.
2. The dossiers of the adopting person and person introduced for adoption shall be submitted to the provincial-level Justice Department of (he place in which the person introduced for adoption permanently resides. The provincial-level Justice Department shall examine the dossiers and consult persons referred to in Article 21 of this Law.
If seeing that the adopting person and person introduced for adoption are eligible under this Law, the provincial-level Justice Department shall submit their dossiers to the provincial-level People's Committee for consideration and decision.
3. Within 15 days after receiving the dossiers from the provincial-level Justice Department, the provincial-level People's Committee shall decide to allow the foreigner permanently residing in Vietnam to adopt the child; in case of refusal, it shall reply in writing clearly stating the reason to the adopting person.
4. Immediately after receiving the provincial-level People's Committee's decision, the provincial-level Justice Department shall register the adoption under the law on civil status registration and organize a child delivery and receipt ceremony at its head office in the presence of a representative of the provincial-level Justice Department, the adopted child, the adoptive parents, a representative of the nurturing center, for children living in nurturing centers, or the natural parents or the guardian of the child, for children living with their families. If the adopting person fails to come to receive the child without a plausible reason, the provincial-level People's Committee shall cancel the decision to allow the foreigner's adoption.
The delivery and receipt of an adopted child must be recorded in a minutes bearing the signatures or fingerprints of the involved parties and the representative of the provincial-level Justice Department.
