How long after divorce can one remarry?
Section 1, Article 57 of the Law on Marriage and Family 2014 stipulates as follows:
- The marital relationship terminates from the effective date of the court’s judgment or divorce decision.
Therefore, when the marital relationship ends, the parties no longer have the rights and obligations of spouses towards each other. The parties are completely free to choose to marry new persons if they meet the conditions for marriage.
Article 8 of the Law on Marriage and Family 2014 prescribes the conditions for marriage as follows:
"1. Men and women getting married must comply with the following conditions:
a) The male must be at least 20 years old, and the female must be at least 18 years old;
b) The marriage must be voluntarily decided by both parties;
c) Neither party shall lose their civil act capacity;
d) The marriage does not fall into one of the prohibited cases by regulations at points a, b, c, and d, Clause 2, Article 5 of this Law.
- The State does not recognize marriage between people of the same sex."
=> These regulations do not specify how long after a divorce one must wait to get remarried. If both parties meet the aforementioned conditions, they are allowed to get married.
Therefore, in your case, you have been divorced for 5 months and have received the court’s judgment, you can now marry a new person if you meet the conditions for marriage.
